XXXXXXXX AND ESCROW. Upon execution of this Agreement, Purchaser shall make an xxxxxxx money deposit in the form of a check in the amount set forth in Section III.B.1, made payable to the order of the Escrow Agent (defined below). Unless otherwise provided herein, all interest earned on the xxxxxxx money deposit and all other deposits made by Purchaser hereunder shall belong to and be credited to the account of Seller, unless the Purchaser requests that said interest be credited to Purchaser in which event a separate interest-bearing account shall be established for Purchaser and Purchaser shall be responsible for all costs of said interest-bearing account and shall provide to the Escrow Agent all information, such as Purchaser's tax identification number, necessary to establish said account and to maintain tax reporting information. Promptly after Xxxxxx's execution and delivery of this Agreement, an escrow account ("Escrow") shall be opened with Fidelity National Title & Escrow of Hawaii ("Escrow Agent") for the purchase and sale of the Lot. Delivery of a fully executed copy of this Agreement to the Escrow Agent and Purchaser's deposit of the xxxxxxx money deposit into Escrow shall constitute the opening of Escrow for the purpose of consummating the purchase and sale of the Lot. This Agreement shall constitute joint escrow instructions of the parties to the Escrow Agent. The parties agree to execute such additional instructions not inconsistent with the provisions of this Agreement which may be required by the Escrow Agent. All payments to be made hereunder shall be paid by Purchaser in the form of a check payable to the order of the Escrow Agent. No cash shall be accepted by Seller or its agents. Xxxxxxxxx agrees that Xxxxxxxxx's funds paid into Escrow pursuant hereto may be disbursed by the Escrow Agent only as provided in this Agreement. Purchaser may, at its sole cost and expense, purchase an owner's policy of title insurance in connection with its purchase of the Lot. Purchaser and Seller do hereby acknowledge and agree that Purchaser need not purchase title insurance covering the Lot from the Escrow Agent or any related entities. Purchaser is free to purchase title insurance from any insurance company authorized to do business in Hawaii.   • Xxxxxxx Money Deposit (a) Within three (3) Business Days after the full execution and delivery of this Contract, Buyer shall deposit the sum of Three Hundred Thousand and No/100 Dollars ($300,000.00) in cash, certified bank check or by wire transfer of immediately available funds (the “Initial Deposit”) with the Title Company, as escrow agent (“Escrow Agent”), which sum shall be held by Escrow Agent as xxxxxxx money.
