Common use of YMCA Group Membership Clause in Contracts

YMCA Group Membership. By January 1, 1988 the City shall offer employees a low or no-cost group membership in the Berkeley Central YMCA. The amount the City contributes toward the employee’s monthly membership fee is subject to federal and state income tax withholding. Use of a YMCA membership by a City of Berkeley employee, as provided for in this Understanding, is non-compensable, is not a part of the employee's work-related duties, is not required for employment and is not condoned as part of a physical fitness program, or required to maintain top physical conditioning for the employee's job performance. The City of Berkeley or its Claims Administrator may not be liable for any injury which arises out of a City of Berkeley employee's participation in and use of a YMCA membership.
