You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, and appropriateness of your Data. Onshape does not guarantee the security of your Data. Onshape will use commercially reasonable efforts to enable you to export your Data in Parasolid (.x_t) and/or other industry standard file formats. However, Onshape does not guarantee that your Data will be available or useable by you following the termination of your subscription or otherwise.

  • ACKNOWLEDGMENT OF RISKS The undersigned recognizes and understands that there are risks associated with their participation in the Activities including, but not limited to, bodily injury or death to persons and damage to property. The undersigned further acknowledges and understands that they will be held liable and responsible for any and all damage to persons, livestock, vehicles, property and/or improvements to property that is caused by them and/or any persons (including, but not limited to, minors) under their care and control, and that arise out of, or are related to, the undersigned’s entry into and participation in the Activities.

  • Electronic and Information Resources Accessibility and Security Standards a. Applicability: The following Electronic and Information Resources (“EIR”) requirements apply to the Contract because the Grantee performs services that include EIR that the System Agency's employees are required or permitted to access or members of the public are required or permitted to access. This Section does not apply to incidental uses of EIR in the performance of the Agreement, unless the Parties agree that the EIR will become property of the State of Texas or will be used by HHSC’s clients or recipients after completion of the Agreement. Nothing in this section is intended to prescribe the use of particular designs or technologies or to prevent the use of alternative technologies, provided they result in substantially equivalent or greater access to and use of a Product.

  • Breach of Authorized User Not Breach of Centralized Contract. An Authorized User’s breach shall not be deemed a breach of the Centralized Contract, rather it shall be deemed a breach of the Authorized User’s performance under the terms and conditions of the Centralized Contract.
