ZONING AND DENSITY. The Property is R‑40C with a density bonus limiting the total number of single-family dwellings within the Development to 190. The City has reviewed the Project. By approving this Agreement, as evidenced by the Mayor’s signature hereto, the Mayor and Council of the City (the “Mayor and Council”) approve the Conceptual Plat, in accordance with Section 40-52 of the Land Development Regulations of the City of Senoia, Georgia (the “Development Regulations”), codified at Chapter 40 of the Code of Ordinances. The Project is a conservation subdivision having no more than 190 residential lots for single-family residences and (subject to Section VI(1) below) the preservation of approximately 55.6 acres (51.4% of the Property) as open or green space, all as shown on the Conceptual Plat. Notwithstanding the foregoing, the Development may include, at the time of initial development or later, streets in addition to those shown on the Conceptual Plat that permit the Development to have interconnect (and provide intercartel connectivity) with contiguous properties. DENSITY BONUS – In accordance with Section 74-113(a) of the Zoning Ordinance, the permitted density in the R-40C district is determined by multiplying the gross acreage of the Project by a factor of 0.9. Said formula yields 97 lots for the Project. In accordance with 74-113(a)(1) of the Zoning Ordinance, and based on the foregoing, the City approves a density bonus of 93 lots for a maximum of 190 lots in the Project.

  • Environmental Regulations The Contractor shall conduct activities in compliance with applicable laws and regulations and other requirements of the Contract relating to the environment and its protection at all times. Unless otherwise specifically determined, the Owner is responsible for obtaining and maintaining permits related to stormwater run-off. The Contractor shall conduct operations consistent with stormwater run-off permit conditions. Contractor is responsible for all items it brings to the Site, including hazardous materials, and all such items brought to the Site by its Subcontractors and suppliers, or by other entities subject to direction of the Contractor. The Contractor shall not incorporate hazardous materials into the Work without prior approval of Owner, and shall provide an affidavit attesting to such in association with the request for the Substantial Completion Inspection.
