Изключения. Настоящата Ограничена Гаранция не се прилага по отношение на: 2.1.1 продукти, които не са произведени от или за Ейсър, или които за пръв път са били продадени на краен потребител в държава, която е извън Териториалния Обхват на тази Ограничена Гаранция. 2.1.2 продукти, които са повредени или дефектни в резултат на: 2.1.2.1 използване на Системата не по предназначение, включително, без ограничения, използване на Системата не в съответствие с Наръчника за потребителя, който придружава Системата, или друга небрежност по отношение на Системата; 2.1.2.2 модифициране на Системата, включително използването на части, които не са произведени или продавани от Ейсър; 2.1.2.3 поправяне или ремонтиране от лице, различно от Ейсър или от Оторизираните доставчици на сервизни услуги на Ейсър; 2.1.2.4 неподходящо транспортиране или опаковане при връщане на Системата на Ейсър или на Оторизирания доставчик на сервизни услуги на Ейсър; или 2.1.2.5 неправилно инсталиране на продукти, произведени от трети лица (напр. карта за памет). 2.1.3 загуба или повреда по отношение на програми, данни, включително в периферни медийни устройства (освен ако е резултат на събитие, пораждащо право на иск съгласно приложимото право в юрисдикцията на Купувача).   • Garden Leave Following the provision of a Notice of Termination either by the Company or by the Executive, the Company may direct, in its sole and exclusive discretion, that the Executive perform no duties, exercise no powers and resign from any office held in connection with his employment with the Company or its Affiliates; provided, however, that, following any such direction, the Executive will continue to be required to comply with his other obligations under this Agreement (and will continue to have a duty of loyalty to the Company as an employee) through the end of the Employment Period.

  • Weekends Off In scheduling shifts the Hospital will endeavour to arrange schedules so as to provide for a minimum of eight (8) weekends off in every twenty-four (24) week period, and, in any event, at least one weekend off in each three (3) week period. Where a weekend off is not granted within a three (3) week period, time worked on such third weekend but not subsequent weekends shall be paid at the rate of time and one-half (1-1/2) unless the Hospital, notwithstanding its best efforts, was unable to meet this standard. This standard shall not apply where: (i) such weekend work was performed by the employee to satisfy specific days off requested by such employee; or (ii) such employee has requested weekend work, or was advised at the time of hire or when the job was posted that the regular schedule normally required continuous weekend work; or (iii) such weekend is worked as a result of an exchange of shifts with another employee; or (iv) the Hospital is unable to comply due to a prohibition against scheduling split days off. It is understood and agreed that there shall be no pyramiding of overtime premiums under the provisions of the Collective Agreement arising out of the foregoing undertakings. The foregoing shall have no application where other scheduling arrangements are provided acceptable to the Hospital and the employees affected and approved by the Union. If an employee who is called on their scheduled weekend off refuses a shift, the refused shift will not be counted as a refused shift, as they are entitled to the weekend off according to the collective agreement.

  • Principal Location Such Grantor’s mailing address and the location of its place of business (if it has only one) or its chief executive office (if it has more than one place of business), are disclosed in Exhibit A; such Grantor has no other places of business except those set forth in Exhibit A.

  • FARES AND TRAVELLING ALLOWANCE In lieu of the basic daily excess fares and travel pattern allowance prescribed by Clause 38.1.1 of the award, a payment per day shall be made for each day worked (including RDO’s). This payment shall in no way limit or be construed as a payment in substitution for any other entitlement arising under Clause 38 of the award. Payments shall be as follows: ⮚ 1/3/03 $22.50 per day ⮚ 1/3/04 $23.40 per day ⮚ 1/3/05 $24.55 per day The cost of Citylink tolls or similar will be reimbursed for those employees who are required by the company to use their own vehicle during working hours, but not for travel to and from work.

  • Headquarters 11.1 This article applies to employees who do not attend at or work at or work from any permanent ministry facility in the course of their duties, but for whom a permanent ministry facility or other place is designated as an employee’s “headquarters” for the purposes of the provisions of this Central Collective Agreement and of various allowances which require a headquarters to be specified. 11.2 A ministry may designate a headquarters when an employee is initially appointed to a position, or when a position is filled by an employee in accordance with Article 6 (Posting and Filling of Vacancies or New Positions), Article 7 (Pay Administration), Article 20 (Employment Stability) of this Central Collective Agreement. All job postings, notices and offers in relation to positions covered by this article shall include the designated headquarters for the position. This designation shall be the location considered by the ministry to be the most convenient for the efficient conduct of the ministry’s business, having regard to the ministry’s projection of the location of the employee’s work assignments for a period of two (2) years. It is not a requirement that the designated headquarters be a facility whose functions are related to the work to be performed by the employee, and the employee’s residence may also be designated as his or her headquarters. The Employer will supply to the Union, by December 30 of each year, a current list of headquarters designations for employees covered by this article. 11.3 By mutual agreement in writing between the ministry and an employee, a new headquarters may be designated for an employee at any time, and by mutual agreement in writing between the ministry and the employee, a temporary or seasonal headquarters may be designated for a stated period, following which the previously designated headquarters will be reinstated unless it has been changed in accordance with this article. 11.4 A ministry may change the headquarters of an employee covered by this article, if: (a) the employee’s residence has been designated as his or her headquarters and he or she subsequently initiates a change of residence; or (b) a ministry facility which has been designated as the employee’s headquarters ceases to operate as a ministry facility; or (c) the employee is assigned to a work location or work locations at least forty (40) kilometres by road from his or her existing headquarters, and it is anticipated that the employee will continue to work in the area of the new work location or work locations for at least two (2) years. 11.5 Where a ministry exercises its right to change the headquarters of an employee otherwise than by mutual agreement with the employee, the following procedure will apply: (a) The ministry shall first give notice to the employee of its intent, and shall consult with the employee to determine the employee’s interests and the employee’s preferences as to the new headquarters location. (b) The ministry shall determine the new headquarters location in a way which is equitable to both the employee and the ministry. (c) The employee shall be given three (3) months’ notice of the change in designation of the headquarters. 11.6 Where it is necessary to identify which one or more of a group of employees is to be assigned to a new headquarters, the employees to be reassigned shall be identified by considering the qualifications, availability, and current location (home, closest facility and work location). Where qualifications, availability and location are relatively equal, length of continuous service shall be used to identify the employee to be reassigned. 11.7 Employees who relocate their residences because of a change in headquarters, other than a temporary or seasonal change, in accordance with this article, shall be deemed to have been relocated for the purposes of the Employer’s policy on relocation expenses.

  • Attention The Assignee’s wire transfer instructions for purposes of all remittances and payments related to the Mortgage Loans and the Seller’s Warranties and Servicing Agreement are:

  • Meal and Rest Breaks (a) The Employer shall make every reasonable effort to organize the work assignment on a shift in such a way as to allow each Nurse to have designated meal and rest break(s) at regular intervals during the shifts. (b) The Employer shall make every reasonable effort to ensure that no Nurse will work longer than five (5) consecutive hours without a break, unless mutually agreed between the Nurse and the Employer. (c) Nurses shall be permitted to combine meal and/or rest break(s) where operationally possible. (d) Operational requirements may require that Nurses remain on the nursing unit or within the facility for their designated meal and rest break(s). (e) Where operational requirements prevent a Nurse from having an uninterrupted meal or rest break(s) and it is not possible to reschedule the missed break(s) or a portion of the break(s) during the remainder of the shift, the Nurse shall be compensated for the portion of the missed meal period or rest period, at a rate of one and one-half times (1.5x) the Nurse’s hourly rate for the period of the rest and meal break(s) missed.
