ОГРАНИЧЕНИЕ И ОТКАЗ ОТ ОТВЕТСТВЕННОСТИ. Тестирование и процедуры гарантии качества Программного обеспечения могут быть не завершены. Поскольку Программное обеспечение подлежит изменениям, SOTI оставляет за собой право менять Программное обеспечение в любое время, и Лицензиат может полагаться на Программное обеспечение только на собственный риск. Предоставление Программного обеспечения по настоящему Соглашению является экспериментальным и не создает никаких обязательств со стороны SOTI по продолжению разработки, производства, поддержки, ремонта, предложения на продажу или любых иных действий по предоставлению или разработке Программного обеспечения либо для Лицензиата, либо для любой другой стороны. Программное обеспечение, предлагаемое SOTI, предоставляется в состоянии «КАК ЕСТЬ» и «ПРИ НАЛИЧИИ» БЕЗ ПРЕДОСТАВЛЕНИЯ ГАРАНТИЙ ЛЮБОГО РОДА ПОЛЬЗОВАТЕЛЮ ИЛИ ЛЮБОЙ ДРУГОЙ ТРЕТЬЕЙ СТОРОНЕ, ВКЛЮЧАЯ, В ЧАСТНОСТИ, ЛЮБУЮ ЯВНУЮ ИЛИ ПОДРАЗУМЕВАЕМУЮ ГАРАНТИЮ ТОВАРНОГО ВИДА ПРОГРАММНОГО ОБЕСПЕЧЕНИЯ, ПРИГОДНОСТИ ЦЕЛЯМ ЛИЦЕНЗИАТА ИЛИ СИСТЕМНОЙ ИНТЕГРАЦИИ, ТОЧНОСТИ ИНФОРМАЦИОННОГО КОНТЕНТА, ОТСУТСТВИЯ НАРУШЕНИЯ ЧЬИХ-ЛИБО ПРАВ, СПОКОЙНОГО ПОЛЬЗОВАНИЯ И НАЛИЧИЯ ПРАВ СОБСТВЕННОСТИ. ЛИЦЕНЗИАТ СОГЛАШАЕТСЯ С ТЕМ, ЧТО ВСЕ УСИЛИЯ SOTI ПО ИЗМЕНЕНИЮ СВОИХ ПРОДУКТОВ ИЛИ УСЛУГ НЕ СЛЕДУЕТ СЧИТАТЬ ОТКАЗОМ ОТ НАСТОЯЩИХ ОГРАНИЧЕНИЙ И ЧТО КАКИЕ-ЛИБО ГАРАНТИИ SOTI НЕ СЛЕДУЕТ СЧИТАТЬ НЕ УДОВЛЕТВОРЯЮЩИМИ ИХ ОСНОВНОЙ ЦЕЛИ. ДАЛЕЕ ЛИЦЕНЗИАТ СОГЛАШАЕТСЯ С ТЕМ, ЧТО SOTI НЕ НЕСЕТ ОТВЕТСТВЕННОСТИ ПЕРЕД ЛИЦЕНЗИАТОМ ИЛИ ЛЮБОЙ ДРУГОЙ ТРЕТЬЕЙ СТОРОНОЙ ЗА ЛЮБОГО РОДА ПОТЕРЮ ПРИБЫЛИ, НЕВОЗМОЖНОСТЬ ИСПОЛЬЗОВАТЬ, ПРОСТОИ В БИЗНЕСЕ ИЛИ ЛЮБОЙ ДРУГОЙ ПРЯМОЙ, КОСВЕННЫЙ, СЛУЧАЙНЫЙ ИЛИ ВТОРИЧНЫЙ УЩЕРБ ЛЮБОГО РОДА, ПОНЕСЕННЫЙ КАК ПО НАСТОЯЩЕМУ СОГЛАШЕНИЮ, ТАК И ПРИ ИНЫХ ОБСТОЯТЕЛЬСТВАХ, ДАЖЕ ЕСЛИ ЛИЦЕНЗИАТ БЫЛ ПРЕДУПРЕЖДЕН О ВОЗМОЖНОСТИ ТАКОГО УЩЕРБА ИЛИ ДОПУСТИЛ ГРУБУЮ НЕБРЕЖНОСТЬ. В ЛЮБОМ СЛУЧАЕ ОБЩАЯ ОТВЕТСТВЕННОСТЬ SOTI ОГРАНИЧИВАЕТСЯ СУММОЙ, РАВНОЙ 50,00 (ПЯТИДЕСЯТИ) ДОЛЛАРАМ США. В некоторых юрисдикциях запрещено исключать или ограничивать ответственность за случайный или вторичный ущерб и, в таком случае, часть приведенных выше ограничений может не применяться к Лицензиату. В таких юрисдикциях ответственность Лицензиата ограничивается максимально допустимой по закону степенью.
