THIS MASTER SERVICES AGREEMENT (together with all Appendices, Exhibits, and Statements of Work hereunder, the “Agreement”) is entered into as of October 15, 2021 (“Effective Date”) by and between Global Atlantic Financial Company (the “Company”) and ExlService Holdings, Inc. The Franklin US Equity Index (LibertyQ U.S. Large Cap Equity Index) (the “Index”), is calculated and maintained by FTSE Russell which aims to reflect the performance of a Franklin Templeton strategy. The Index is licensed for use by Forethought Insurance Company (“Forethought”). Forethought’s annuity products are not in any way sponsored, endorsed, sold or promoted by Franklin Templeton, Russell or the London Stock Exchange Group companies (“LSEG”) (together the “Licensor Parties”) and none of the Licensor Parties make any claim, prediction, warranty or representation whatsoever, expressly or impliedly, either as to (i) the results to be obtained from the use of an Index (upon which Forethought’s annuity products are based), (ii) the figure at which an Index is said to stand at any particular time on any particular day or otherwise, or (iii) the suitability of an Index for the purpose to which it is being put in connection with the Forethought annuity product. (“FINRA”), (“Distributor”), Forethought Life Insurance Company (“Company”), and an independent broker-dealer registered with the SEC under the 1934 Act and a member of FINRA (“Broker-Dealer”), and any and all undersigned insurance agency affiliates (“Affiliates”) of Broker-Dealer. Distributor and Company are sometimes collectively referred to as (“Forethought”).
