Sankční opatření. Klient se zavazuje, že Klient a každý Subjekt ze skupiny po celou dobu trvání Rámcové smlouvy: a) neposkytne prostředky z Financování jakýmkoli způsobem (zejména jako zápůjčku nebo úvěr), jehož důsledkem by bylo porušení Sankcí Bankou (včetně případů využití prostředků z Financování za účelem financování obchodů nebo transakcí Sankcionované osoby nebo osob s ní spojených nebo jako důsledek poskytnutí těchto prostředků Sankcionované osobě nebo v její prospěch); b) zajistí, že žádná osoba, která je Xxxxxxxxxxxxxx osobou, nebude mít právo na prostředky, které Klient Bance splácí nebo převádí v souvislosti s Financováním a že žádný výnos nebo příjem související s činností nebo transakcí Sankcionované osoby nebude použit pro uhrazení částek, které je Klient povinen Bance uhradit dle Rámcové smlouvy. The Client undertakes, for the term of the Frame Agreement, that the Client and each Group Member shall: a) not use the proceeds of Financing in any manner (in particular as a loan or credit) that would results in a violation of the Sanctions by the Bank (including as a result of these proceeds of Financing having been used to fund the business or transactions of a Sanctioned Person or a person associated therewith, or as a result of these funds having been available to a Sanctioned person or having benefited such person); b) ensure that no person that is a Sanctioned Person will have any right to the funds repaid or remitted by the Client to the Bank in connection with Financing and that no revenue or benefit derived from any activity or transactions with the Sanctioned Person will be used to discharge amounts owing by the Client to the Bank under the Frame Agreement.
