Additional Space Rent Commencement Date means the date which is sixty (60) days after the earliest of (x) occupancy by Tenant of any portion of the Additional Space for conduct of its business, or (y) the date that Tenant’s Additional Space Work (as hereinafter defined) is substantially completed. Additional Space Rent Commencement Date in respect of the Additional Space shall be deemed to mean the date which is the one (1) year anniversary of the date of this First Amendment.
Additional Space Rent Commencement Date means the date which is sixty (60) days after the earliest of (x) occupancy by Tenant of any portion of the Additional Space for conduct of its business, or (y) the date that Tenant’s Additional Space Work (as hereinafter defined) is substantially completed. For purposes hereof, the sixty (60) day period described above is referred to herein as the “Abatement Period” and shall be subject to reduction as set forth below. Landlord shall confirm the Additional Space Delivery Date and the Additional Space Rent Commencement Date and shall provide Tenant with written notice of said dates. When said dates have been so determined, at Landlord’s or Tenant’s request, the parties hereto shall within fifteen (15) days after such request, execute a written agreement confirming said dates. ​ Any failure of the parties to execute such written agreement shall not affect the validity of said dates as aforesaid.

Additional Space Rent Commencement Date means the date on which Sublessor provides written notice to Sublessee stating that (i) the systems serving the Additional Space are operational, (ii) Sublessor has fulfilled its obligations pursuant to the first sentence of Section 5 of this Amendment, and (iii) a copy of a certificate of occupancy with respect to the Additional Space is attached thereto. Sublessee shall be responsible for all Additional Rent associated with the Additional space beginning on the Additional Space Rent Commencement Date. For purposes of Sections 3(e) and 3(f) of the Sublease, Sublessee’s Proportionate Share shall, beginning on the Additional Space Rent Commencement Date, equal 26.8%, which figure represents a fraction, the numerator of which is the number of square feet within the Subleased Premises (including the Additional Space) (approximately 33,427 square feet, as such may be adjusted following any exercise by the Sublease of its right of first refusal in the Sublease) and the denominator of which is the number of square feet within the Building (approximately 124,838 square feet).

Failure by Tenant to obtain validation by any medical review board or other similar governmental licensing of the Premises required for the Permitted Use by Tenant shall not serve to extend the Term Commencement Date.

  • Expansion Space means any space in the Building which, at any time during the Lease Term, is occupied by a Person other than Landlord under a written lease with Landlord, and the term “Tenant’s Expansion Space” means Expansion Space which Tenant has elected to lease as provided in this paragraph. Landlord agrees to notify Tenant promptly after Landlord learns that any Expansion Space is or will become available. Subject to the prior rights of other tenants to whom Landlord has granted substantially similar rights, Tenant has the option to lease any Expansion Space which Landlord notifies Tenant is or will become available.
