Affixation. Borrower covenants and/or agrees as follows: That the Manufactured Home is affixed to a permanent foundation on the Property; That the Borrower(s) have complied with all Applicable Laws regarding the affixation of the Manufactured Home to the Property; That by execution of this Rider, the Borrower will grant to the Lender a limited power of attorney from the Borrower to the Lender to act on his behalf to surrender the certificate of title to the Manufactured Home, if surrender is permitted by Applicable Law, and to obtain all requisite governmental approvals and documentation necessary to classify the Manufactured Home as real property under applicable Law; that affixing the Manufactured Home to the Property does not violate any zoning laws or other local requirements to the Property; that the Manufactured Home will be, at all times and for all purposes, an immovable fixture that is a permanent improvement to the Property, is permanently affixed to, and part of, the Property and will be treated as real property under applicable law.
Affixation. This section applies until such time as title to the goods passes to the Customer in accordance with this agreement. The Customer must ensure that no item of the goods is or becomes affixed to any real or personal property except to the extent necessary to enable that item to be properly used and the prior written consent of the Company has been obtained, and in any event, must ensure that no item of goods becomes a fixture. Even if an item of the goods is or becomes affixed to any real property, it does not become a fixture and remains the Company’s property, removable in accordance with this agreement. The Company is entitled to enter any place at any time for the purpose of removing the goods and will not be liable in respect of loss or damage arising from such entry or from the removal of the goods. If, despite the above paragraphs:
Affixation. If SEC affixes a patent notice to any Covered TDMA Subscriber Units or Covered TDMA Infrastructure Units [***], it shall [***] affix to such Covered TDMA Subscriber Units or Covered TDMA Infrastructure Units a similar notice with respect to the Licensed Patents ([***]) as reasonably designated by ITC. *** Confidential material which has been omitted and filed separately with the Securities and Exchange Commission.
