ANDA Settlement Distributor definition

ANDA Settlement Distributor means a Third Party, who, in connection with the settlement of an ANDA litigation proceeding under the Xxxxx-Xxxxxx Act and Medicare Prescription Drug, Improvement and Modernization Act of 2003, has been licensed or otherwise permitted by Depomed or Santarus, as applicable (subject to Section 12.2), to sell a Generic Version of a Product in the Territory.
