Defendant will pay the Gross Settlement Fund in two installments.
In consideration for releases and promises contained in this Agreement, and subject to Court approval, Defendant agrees to pay the amount of the Gross Settlement Fund into an interest-bearing account established and administered by the Settlement Administrator.
If the Settlement Agreement is not finally approved for any reason, any monies paid toward the Gross Settlement Fund belong to Defendant, less any Administrative Expenses incurred.
Administrative Expenses shall be paid to the Settlement Administrator from the Gross Settlement Fund and may be drawn after the first installment payment is deposited into the Settlement Fund as discussed in Paragraph 39(vii), above.
Within twenty-one (21) days after the Effective Date, the Settlement Administrator shall pay the Service Award to Plaintiff from the Gross Settlement Fund via a check made payable to Plaintiff and mailed to the address identified on the W-9 tax form provided by Plaintiff to the Settlement Administrator in advance thereof.
