It is the sole responsibility of the Applicant to ensure that the Construction of the Structure is in compliance with the Airport Master Plan, the Approved Land Use Plan, this By- law, the Development Rules and all Applicable Codes and Standards.
If the Permit Section is satisfied that the Construction of the Structure does not violate the requirements of this By-law, the Development Rules, the Airport Master Plan, the Approved Land Use Plan, or the Applicable Codes and Standards, and it does not receive an objection from an Airport Authority Department or affected party, it shall issue a Development Permit.
Subject to Section 6.6, upon receipt of an application for a Facility Permit which complies with the requirements of this By-law and the Development Rules and does not violate the Airport Master Plan, the Approved Land Use Plan or the Applicable Codes and Standards, and if it does not receive an objection from an Airport Authority Department or affected party, and if all applicable fees and all other amounts have been paid, the Permit Section shall issue a Facility Permit to the Applicant.
This includes lands on the south side of Taunton Road East and on the west side of Harmony Road North that are proposed for commercial uses in the Council Approved Land Use Plan for the Taunton-Harmony Corridor study area as shown in Exhibit No. 4.
The Permit Section may revoke a Facility Permit where it comes to the attention of the Permit Section that there is a violation by the Applicant of a condition under which the Facility Permit was issued or of a requirement of the Applicable Codes and Standards, the Environmental Standards, the Bylaw, the Development Rules, the Airport Master Plan, or the Approved Land Use Plan.
The Council Approved Land Use Plan did not affect the existing Harmony Shopping Centre/The Home Depot site but addressed the vacant 3.9 hectare (9.5 ac.) parcel of land owned by the applicant and subject to the proposed expansion of the Harmony Shopping Centre in the current applications.
