Bare Transfer definition

Bare Transfer has the meaning given in clause 12.2(a).
Bare Transfer means a transfer or assignment by the Shipper of its entitlement to capacity under the Access Contract in circumstances where:
Bare Transfer means an assignment under which the assignor assigns the whole or a part of its access rights under an access contract to an assignee, but under which there is no novation, with the result that the assignor’s obligations under the access contract for services, and all other terms of the access contract for services, remain in full force and effect after the assignment, whether or not the assignee becomes bound to the assignor or any other party to fulfil those obligations.

Examples of Bare Transfer in a sentence

  • For an Assignment* other than a Bare Transfer*, the User* may Assign* its Access Rights* subject to compliance with the Transfer and Relocation Policy*.

  • Subject to clause 31.2, the User* may make a Bare Transfer* of its Access Rights* under the Transfer and Relocation Policy* without Western Power*’s prior written consent.

  • A Network User is permitted to transfer or assign all or part of its Contracted Capacity (other than by way of a Bare Transfer) with the prior written consent of Envestra, where the transfer or assignment is commercially and technically reasonable.

  • For an Assignment other than a Bare Transfer, the User may Assign its Access Rights subject to compliance with the Transfer and Relocation Policy.

  • A User may make a Bare Transfer to another person (the transferee) without the consent of APT Allgas in accordance with Rule 105.


More Definitions of Bare Transfer

Bare Transfer means a transfer or assignment of any interest in the right to obtain a Service (including, but without limitation, a sub-licence) in which the contract between CRP and the User remains in effect in terms identical to those existing between CRP and the User immediately prior to that transfer or assignment.
Bare Transfer means an Assignment under which the User Assigns the whole or a part of its access rights under this Contract to an assignee, but under which there is no Novation, with the result that the User’s obligations under this Contract, and all other terms of this Contract, remain in full force and effect after the Assignment, whether or not the assignee becomes bound to the User or any other party to fulfil those obligations.
Bare Transfer means in respect of a User a transfer or assignment of all or part of the MDQ of a User under a Service Agreement to the extent that:

Bare Transfer means an agreement entered into in accordance with clauses 13.1(a) and 13.3 in relation to Traded Capacity;
