For anything not mentioned in subsection (1)(a), (b) or (c), the Acts Interpretation Act 1954, sections 19, 20 and 20A apply to this Act as if this Act had been repealed by the BCCM Act.
That consideration was a factor which influenced Helman J in Devine Ltd v Timbs8 in determining that the relevant date for the application of the provisions of the PAMD Act and the BCCM Act in that case was the date of the execution of the option agreements, rather than the much later date when the put options were exercised.
