Canadian Multiemployer Plan definition

Canadian Multiemployer Plan means a “multi-employer pension plan” as defined by Canadian Pension Laws and registered in accordance with Canadian Pension Laws and as to which any Credit Party or any Subsidiary thereof is making, or is accruing an obligation to make, or has accrued an obligation to make contributions within the preceding six (6) years, and shall not include any Multiemployer Plan.
Canadian Multiemployer Plan means a Canadian Pension Plan that is contributed to by a Canadian Loan Party for its employees or former employees pursuant to a collective agreement or participation agreement but which is not maintained or administered by the Canadian Loan Party.
Canadian Multiemployer Plan means each “multi-employer plan” within the meaning of subsection 147.1(1) of the Tax Act to which any Loan Party contributes or is under an obligation to contribute in respect of any employees of a Loan Party who primarily perform employment services in Canada, where such contributions or obligations to contribute are pursuant to a collective bargaining agreement, trust agreement, participation agreement or otherwise, and where such “multi-employer plan” is neither sponsored nor administered by any Loan Party.
