Neither Trustor nor any tenant or other person shall remove, demolish or alter any improvement now existing or hereafter erected on the Property or any fixture, equipment, machinery or appliance in or on the Property except when incident to the replacement of fixtures, equipment, machinery and appliances with items of like kind; provided however, that Trustor may make non-structural alterations to the Property or improvements thereon to the extent permitted by the Casino Lease.
Subject to the rights of Trustor under the Casino Lease, Beneficiary may make or cause to be made reasonable entries upon and inspections of the Property (including, but not limited to, phase I and/or phase II environmental audits and inspections).
The Company shall at all times (i) maintain the registration of the Collateral Agent as the Registered Leasehold Mortgagee under (and as defined in) the Casino Operating Contract, (ii) provide the RDC with the notice address for the Collateral Agent under (and as defined in) the Casino Lease and (iii) cause a copy or will deliver a copy of any notice provided by the LGCB or the RDC to the Collateral Agent to be delivered at the same time to the Trustee.
