Category 3 Storm definition

Category 3 Storm means a category 3 storm as defined by the Xxxxxx-Xxxxxxx Hurricane Wind Scale. Change in Law – means the enactment, adoption, promulgation, modification, suspension, repeal, or judicial determination, after the Effective Date, by any Governmental Authority of any Legal Requirement that materially affects the costs associated with a Party’s performance of its obligations hereunder or its ability to perform its obligations hereunder. For the avoidance of doubt, neither of the following shall be considered a Change in Law: (a) a new Legal Requirement imposed on the Project that is not applicable generally to electric generating facilities, or (b) a change in interpretation or enforcement of any existing Legal Requirement. Charging Energy - means Energy supplied by Xxxxx and delivered to the Project to be stored by the Project.
