CCS Directive definition

CCS Directive means directive 2009/31/EC of the European Parliament and of the Council of 23 April 2009 on the geological storage of carbon dioxide and amending Council Directive 85/337/EEC, European Parliament and Council Directives 2000/60/EC, 2001/80/EC, 2004/35/EC, 2006/12/EC, 2008/1/EC and Regulation (EC) No 1013/2006 with subsequent amendments.

  • Both countries have laws in place to enable CCS, having incorporated the CCS Directive into their national law.

  • Article 19 of the EU CCS Directive requires Member States to ensure potential operator’s evidence financial security as part of their application for a storage permit to cover both foreseen and unforeseen events and costs, the latter related to leakages of CO2, and for extra monitoring, remediation throughout all phases of project etc.

  • This would be in absence of the European Commission enacting regulation/guidance of CCS beyond that currently provided under the CCS Directive which requires Member States to undertake ‘transboundary cooperation’ under Article 24.

  • In June 2009, the EU enacted the Directive 2009/31/EC on the geological storage of carbon dioxide (CCS Directive) as part of the EU Climate and Energy package.

  • However, the current EU’s CCS Directive leaves the decision to allow carbon storage on their territory to individual MSs and makes no provision for limiting local bans of CCS.
