The issuance of a Certificate for Payment will further constitute a representation that the Contractor is entitled to payment in the amount certified. However, the issuance of a Certificate for Payment will not be a representation that the Architect has (1) made exhaustive or continuous on-site inspections to check the quality or quantity of the Work, (2) reviewed construction means, methods, techniques, sequences or procedures, or (3) made examination to ascertain how or for what purpose the Contractor has used money previously paid on account of the contract Sum. 9.4.2 If the Contractor has submitted a timely and proper application for payment in accordance with this article, payment may be expected with twenty-five (25) business days of the receipt of the approved proper application. Payment for a proper application reducing or releasing retainage may exceed this duration

CERTIFICATES FOR PAYMENT. District shall review the Contractor’s Application for Payment within a reasonable time after receipt not to exceed seven (7) days for the purpose of determining that it is properly submitted. District shall either return the Application for Payment to Contractor with a document setting forth the reasons why the Application for Payment is not proper, or shall issue a Certificate for Payment for the amounts properly due. District’s issuance of a Certificate for Payment is a representation by District, based upon District’s evaluation of the Work and the data comprising the Application for Payment, that Contractor is entitled to payment in the amount certified because the Work has progressed to the point indicated and that the quality of the Work is in accordance with the Contract Documents. District’s approval of the certified Application for Payment is based on Contractor complying with all requirements for a fully complete and valid certified Application for Payment.

The Contract Time and the Contract Sum shall be equitably adjusted due to the delay.
