Class II violation definition

Class II violation means a pattern of noncompliance by a nursing home or certified nursing facility 1341 with one or more federal conditions of participation which indicates delivery of substandard quality of 1342 care but does not necessarily create an immediate and serious threat to patient health and safety. 1343 Regardless of whether the facility participates in Medicare or Medicaid, the federal conditions of 1344 participation shall be the standards for Class II violations.
Class II violation means any violation of a statute or rule relating to the operation or maintenance of a health facility or agency which has a direct or immediate relationship to the health, safety, or security of patients or residents in a health facility or agency.

Examples of Class II violation in a sentence

  • If an employee commits any Class I or Class II violation and the disciplining authority deems it in the best interest of all concerned to issue only a Written Warning, and not to initiate any other formal disciplinary measures, the disciplining authority may issue a Written Warning.
