CLEC Certification. 8.1 Notwithstanding any other provision of this Agreement, CenturyLink shall have no obligation to perform under this Agreement until such time as CLEC has obtained such FCC and Commission authorization(s) as may be required by Applicable Law for conducting business in the State as a competitive local exchange carrier. CLEC shall not be permitted to establish its account nor place any orders under this Agreement until it has obtained such authorization and provided proof of such to CenturyLink. For the life of this Agreement, CLEC must represent and warrant to CenturyLink that it remains a certified local provider of Telephone Exchange Service within CenturyLink’s Local Calling Area(s) in the State. At any time during the life of this Agreement, CLEC will provide a copy of its current Certificate of Operating Authority or other evidence of its status to CenturyLink upon request. CLEC’s failure to maintain such authorization(s) as may be required by Applicable Law for conducting business in the State as a CLEC shall be considered a Default of Agreement.

CLEC Certification. 1.1 TWTC agrees to provide AT&T in writing TWTC’s CLEC certification for all states covered by this Agreement except Kentucky prior to AT&T filing this Agreement with the appropriate Commission for approval.
1.2 To the extent TWTC is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, TWTC may not purchase services hereunder in that state. TWTC will notify AT&T in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, TWTC may thereafter purchase services pursuant to this Agreement in that state. AT&T will file this Agreement with the appropriate Commission for approval.
1.3 Should TWTC’s certification in any state be rescinded or otherwise terminated, AT&T may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, and AT&T may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the initial term of this Agreement. TWTC shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
CLEC Certification. 1.1 Universal Telecom, Inc agrees to provide AT&T in writing Universal Telecom, Inc’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to AT&T filing this Agreement with the appropriate Commission for approval. Additionally, Universal Telecom, Inc shall provide to AT&T an effective certification to do business issued by the secretary of stateor equivalent authority in each state covered by this Agreement.
1.2 To the extent Universal Telecom, Inc is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, Universal Telecom, Incmay not purchase services hereunder in that state. Universal Telecom,cInwill notify AT&T in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of stateor equivalent authority for, any other state covered by this Agreement. Upon receipt therfe, AoT&T will file this Agreement in that state, and Universal Telecom, Incmay purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3.
1.3 Should Universal Telecom, Inc’s certification in any state be rescinded or otherwise terminated, AT&Tmay, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or AT&Tmay refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. Universal Telecom, Inc shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
CLEC Certification. 1.1 Image Access agrees to provide BellSouth in writing Image Access’s CLEC certification for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval.
1.2 To the extent Image Access is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, Image Access may not purchase services hereunder in that state. Image Access will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Image Access may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. Image Access shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
1.3 Should Image Access’s Commission or secretary of state (or equivalent authority) certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately in such state and all monies owed on all outstanding invoices for services provided in such state shall become due. Additionally, BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. Image Access shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
CLEC Certification. 1.1 Freedom agrees to provide BellSouth in writing Freedom’s CLEC certification for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval.
1.2 To the extent Freedom is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, Freedom may not purchase services hereunder in that state. Freedom will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Freedom may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval.
1.3 Should Freedom’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, and BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the initial term of this Agreement. Freedom shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
CLEC Certification. 1.1 <<customer_name>> agrees to provide BellSouth in writing the certificate number or docket number, for the docket pending certification, for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate commission for approval.
CLEC Certification. 1.1 Metro Teleconnect agrees to provide BellSouth in writing Metro Teleconnect’s CLEC certification for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval.
1.2 To the extent Metro Teleconnect is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, Metro Teleconnect may not purchase services hereunder in that state. Metro Teleconnect will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Metro Teleconnect may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval.
1.3 Should Metro Teleconnect’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, and BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the initial term of this Agreement. Metro Teleconnect shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
CLEC Certification. 1.1 ComSouth agrees to provide BellSouth in writing ComSouth’s CLEC certification from the Commission for the state of Georgia prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, ComSouth shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
1.2 To the extent ComSouth is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, ComSouth may not purchase services hereunder in that state. ComSouth will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and ComSouth may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 7.
1.3 Should ComSouth’s Commission/CLEC certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until Commission/CLEC certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. Additionally, once Commission//CLEC certification is reinstated, ComSouth shall again provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
CLEC Certification. 1.1 Cinergy Communications Company agrees to provide BellSouth in writing the certificate number or docket number, for the docket pending certification, for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate commission for approval.
1.2 Additionally, Cinergy Communications Company will notify BellSouth in writing when it becomes certified or has a docket pending certification to operate in any other state in the BellSouth region. Upon notification, BellSouth will file this Agreement with the appropriate commission for approval.
