Under this Evaluation License Customer has the right to: (i) Use Tellius software deployed on Customer servers for a limited period or activate an instance of the software on a Cloud Marketplace (for purpose of clarification, a “Free Trial” or BYOL Trial is deemed an Evaluation License).

Each party’s entire liability for all claims in the aggregate arising from or in connection to the Cloud Marketplace Beta, a Cloud Product, or this Agreement will not exceed the amount of any 1) damages for bodily injury (including death) and damage to real property and tangible personal property and 2) other actual direct damages up to $10,000.00, regardless of the basis of the claim.

Cosmian shall make the Updates and Upgrades and the corresponding Documentation available to Customer on the Azure Cloud Marketplace.
