Failure to respond to or meet any of the requirements set out in this RFT and the Tender Documents will result in the Tender being deemed a Non- Conforming Tender.
A Conforming Tender is a Tender which meets all of the requirements set out in this RFT and the Tender Documents.
Any letter or other form of written or oral acknowledgment by Council of receipt of the Tender and the Tender Deposit (where applicable) does not imply that the Tender has been admitted or accepted as a Conforming Tender or a Non-Conforming Tender and nor does it constitute any representation by Council as to any other matter.
Where a Tenderer seeks to vary the Tender Criteria of Council, the Tenderer may, subject to this clause, in addition to any Conforming Tender submitted, also submit an Alternative Tender clearly marked as ‘Alternative Tender’.
Tenders shall be evaluated according to the principle of the Lowest Price Conforming Tender Method as shown in the Competitive Pricing Procedures Manual, Volume 1 Physical Works and Professional Services published by NZTA.
