Together these phases make up a Period of Service, unless the Participant reaches 52 Consecutive Weeks in Employment from the Anchor Date, or is Exited.
The Provider must not set the Employment Placement Start Dates unless there is a reasonable expectation that the Participant will continue in the Employment for a minimum of 13 Consecutive Weeks of Employment.
For example, if a Participant with an Employment Benchmark of 15 hours worked 195 hours in 10 Consecutive Weeks from the Anchor Date but lost their Employment before the completion of the 13-week Period, an Outcome would not be payable.
The 13 Consecutive Weeks of Employment will comprise the time the Participant was employed in the first job, and the required time to make a total of 13 Consecutive Weeks from the second job or subsequent jobs.
The Suspension will ‘halt’ the counting of 13 Consecutive Weeks or 26 Consecutive Weeks in the Department’s IT System, and the number of days of the Suspension will not count towards the 13‑week Period or 26-week Period or 52-week Period.
Subject to clause 139.4, where an Exit occurs for a Participant, but the Participant returns to the Program Services less than 13 Consecutive Weeks after the date of the Exit, the Participant’s previous Period of Service is deemed to continue from the date of the return and the Provider must, as soon as it becomes aware of the return: resume providing Program Services to the Participant; and record the resumption of Program Services on the Department’s IT Systems, in accordance with any Guidelines.
Where an Exit occurs and the Participant subsequently returns to the Program Services at 13 Consecutive Weeks or more after the date of the Exit, the Participant must have a Valid ESAt or JCA and, subject to that ESAt or JCA, begin a new Period of Service, unless the Participant is returning as a Work Assist Participant (in which case the Participant does not require a Valid ESAt or JCA).
Claiming a Work Assist Outcome Fee where there is Permissible Break(s) If the break in an Employment related activity meets the requirements for a Permissible Break then a DES Provider needs to consider the length of the break and the necessary period of extension to the actual length of the 26 Consecutive Weeks.
The DES Provider must continue providing Work Assist Services for 26 Consecutive Weeks until the Participant achieves an Outcome.
Multiple breaks may be accepted during the 26 Consecutive Weeks up to a maximum of eight weeks in total if the Participant returns to their original Employer and meets the requirements for a Work Assist Outcome at the time of the Outcome Fee claim.
