Examples of Consolidated Cash Balance Threshold in a sentence
If, (a) as at the end of any calendar month, the Consolidated Cash Balance exceeds the Consolidated Cash Balance Threshold and (b) the outstanding principal balance of Debt permitted by Section 9.02(m) is greater than zero, then the Borrower shall, within five (5) Business Days of becoming aware of any such excess, repay any Debt permitted by Section 9.02(m) in an aggregate principal amount, plus accrued interest, if any, equal to such excess.
If, (a) as of the end of any calendar month, the Consolidated Cash Balance exceeds the Consolidated Cash Balance Threshold and (b) any Loans are then outstanding, then the Borrower shall, within five (5) Business Days of becoming aware of any such excess repay any Loans outstanding in an aggregate principal amount, plus accrued interest, if any, equal to such excess.
After giving effect to each Advance and the application of the proceeds thereof within three (3) Business Days from the date such Advance is made, the pro forma Consolidated Cash Balance Amount shall not exceed the Consolidated Cash Balance Threshold.
In the exercise of its Non-Profit Sector rights hereunder, CAS may license, delegate or assign such rights as it deems fit in its sole and absolute discretion.
The undersigned further certifies, represents and warrants on behalf of the Borrower that (a) the Borrower is entitled to receive the requested Borrowing under the terms and conditions of the Credit Agreement and (b) after giving effect to the requested Borrowing, the Consolidated Cash Balance does not exceed the Consolidated Cash Balance Threshold.
