The Owner shall deliver all documents and complete all activities within the time periods set forth on Exhibit "B." Upon receipt of the Construction Notice to Proceed, the Contractor shall commence performance of the Work at or on the Project site within ten (10) days.
Notwithstanding the foregoing sentence, as to Materials purchased by Contractor (other than as agent for Company) prior to Construction Notice to Proceed, Contractor shall bear the risk of physical loss of or damage to such Materials until cure, custody and control is transferred to Company.
The Loan Servicer shall have received certification and evidence from the Borrower that with respect to each of the Equipment Contract, the EPC Contract, and each Well Drilling Contract that is required to have been entered into on or before the Initial Advance Date, Borrower either (i) has issued a Construction Notice to Proceed or (ii) has made arrangements satisfactory to the Loan Servicer for the issuance of such Construction Notices to Proceed simultaneously with the Initial Advance Date.
Upon receipt of the Pre-construction Notice to Proceed, the Contractor shall begin the Work hereunder, provided, however, that the Contractor shall not perform any Work at or upon the Project site until receipt of a written "Construction Notice to Proceed." Upon substantial completion of the excavation work at the Project site, which work is being performed by Xxxxxxxx Contractors, the Owner shall issue a Construction Notice to Proceed to the Contractor.
