Container Charge definition

Container Charge means a refundable deposit that may be assessed for kegs.
Container Charge ten percent (10%) of the Suggested Retail List Price for a single-fold analog disc Record in a standard sleeve with no insert; fifteen percent (15%) of the Suggested Retail List Price for an analog disc Record in a double-fold or gatefold jacket, in a nonstandard sleeve or jacket, or with inserts; twenty percent (20%) of the Suggested Retail List Price for analog cassette tape Records and for audiovisual Records; and twenty­-five percent (25%) of the Suggested Retail List Price for Records in the form of Compact Discs, Digital Compact Cassettes, Mini-Discs, Records sold in the form of other digital configurations, audiophile Records, Records sold in the form of any other new configurations, and for any other Record other than as herein provided. Without limiting the foregoing, there will not be a Container Charge with respect to Electronic Transmissions of Masters.
Container Charge means a percentage of the Dealer Price of a Record or Audio Visual Device (as the case may be) deducted prior to calculation of the royalty due which notionally represents that proportion of the Dealer Price which relates to the packaging of such Record or Audio Visual Device and being as follows: in respect of 7” vinyl Singles in special bags - *** per cent (***%); in respect of 12” vinyl Singles in special bags and other non-Album vinyl Records -*** per cent (***%); in respect of vinyl Albums and audio cassette tapes - *** per cent (***%); in respect of compact discs, Audio Visual Devices and New Technology Records - *** per cent ***%).

  • Prior to the end of each fiscal year throughout the term of this Agreement, DISTRICT and HAULER shall review in good faith the status of the Additional Container Charge Program.
