Container Charge definition

Container Charge means a refundable deposit that may be assessed for kegs.
Container Charge ten percent (10%) of the Suggested Retail List Price for a single-fold analog disc Record in a standard sleeve with no insert; fifteen percent (15%) of the Suggested Retail List Price for an analog disc Record in a double-fold or gatefold jacket, in a nonstandard sleeve or jacket, or with inserts; twenty percent (20%) of the Suggested Retail List Price for analog cassette tape Records and for audiovisual Records; and twenty­-five percent (25%) of the Suggested Retail List Price for Records in the form of Compact Discs, Digital Compact Cassettes, Mini-Discs, Records sold in the form of other digital configurations, audiophile Records, Records sold in the form of any other new configurations, and for any other Record other than as herein provided. Without limiting the foregoing, there will not be a Container Charge with respect to Electronic Transmissions of Masters.
Container Charge. The applicable percentage, specified below, of the Gross Royalty Base (net of all taxes included in such Gross Royalty Base Price) applicable to the Records concerned:

  • Royalty Base Price" shall mean the amount specified below ("Gross Royalty Base") applicable to the Phonograph Records concerned, less all excise, purchase, value added, or similar taxes (included in the Royalty Base Price) and less the applicable Container Charge.

Container Charge means a percentage of the Dealer Price of a Record or Audio Visual Device (as the case may be) deducted prior to calculation of the royalty due which notionally represents that proportion of the Dealer Price which relates to the packaging of such Record or Audio Visual Device and being as follows: in respect of 7” vinyl Singles in special bags - *** per cent (***%); in respect of 12” vinyl Singles in special bags and other non-Album vinyl Records -*** per cent (***%); in respect of vinyl Albums and audio cassette tapes - *** per cent (***%); in respect of compact discs, Audio Visual Devices and New Technology Records - *** per cent ***%).
Container Charge the applicable percentage, specified below, of the Gross Royalty Base applicable to the Records concerned:
Container Charge. The following applicable percentage of the Retail List Price of each Record: ten percent (10%) for a Record in a single sleeve other than a black vinyl Single in a stock paper sleeve; twenty percent (20%) for a Record (including a Single) in the form of a pre-recorded analog tape (other than a chrome treated tape) or a Record in a gatefold sleeve; twenty-five percent (25%) for Records (including a Single) sold in boxed sets or in the form of a pre-recorded chrome treated tape, digital audio tape, compact disc, New Technology Configurations, via satellite or in any other form or configuration of Records, package, container or box other than as described herein; plus an additional two and one-half percent (2 1/2%) for each of the following: printed bag, insert, wrapping other than shrink wrap, and other special element (including, without limitation, a sticker) that is included with any of the coinfigurations of a Record described in this paragraph 13.12.
Container Charge means the applicable percentage, specified as follows, of the Gross Royalty Base applicable to the particular * Record concerned: XXXXXXXXXXXXXXX percent for Singles packaged in color or other special printed sleeves, and for Albums, EPs, and Long-Playing Singles in disc form packaged in Company's standard singlefold jackets without any special elements (such as, but not limited to, plastic, cardboard, or printed * inner sleeves, inserts, or attachments); XXXXXXXXXX percent thereof for all other Albums, EPs or Long-Playing Singles in disc form, and for all other * sound-only Phonograph Records in disc form; and XXXXXXXXXX percent thereof for Audiovisual Records, all Phonograph Records in tape form, such as reel-to-reel tapes, cartridges, cassettes (whether audio or video) and for all other * recorded devices, but XXXXXXXXXXX percent for compact disc Records, digital audio tape, DCC, Mini-disc and all Records in New Configurations. Notwithstanding anything to the contrary contained herein, in the event that the majority of the agreements by and between Company and the majority of other recording artists signed to exclusive recording agreements with Company contain provisions for Container Charges less than those provided for herein, then this agreement shall be deemed automatically amended to contain such more favorable terms.
