County Fault definition

County Fault means any breach (including the untruth or breach of any County representation or warranty herein set forth), failure, nonperformance or noncompliance by the County with respect to its obligations and responsibilities under this Contract to the extent not directly attributable to any Uncontrollable Circumstance, and which materially and adversely affects the Company’s rights, obligations or ability or costs to perform under this Contract.
County Fault means (a)(1) any material breach, failure, nonperformance or noncompliance by the County with the terms and provisions of this Agreement for any reason, other than Uncontrollable Circumstance or Manager Fault; or (2) any negligence or willful misconduct of any officer, agent, employee, subcontractor or independent contractor of the County (other than the Manager, any Subcontractor or the Completion Certifier) which, in the case of (a)(1) or (2) of this definition, prevents or materially delays, either individually or cumulatively (i) the County’s performance of its obligations under this Agreement, or (ii) the Manager’s performance of its obligations under this Agreement or which deprives the Manager of any of its material rights under this Agreement; or (b) any knowing and willful act of any officer or employee of the County which directly (i) prevents or materially delays the Work on the relevant Approved Project, or (ii) causes a material increase in the Actual Project Costs for such Project (but this clause (b) shall exclude (X) any act of the County caused by or attributable to an Uncontrollable Circumstance or the fault, failure, delay, negligence or willful misconduct of the Manager or any Subcontractor and (Y) any act of the County suspending Subcontractor work for a period of not more than thirty (30) days in accordance with Section 4.6.2). For purposes of making determinations pursuant to clause (b), the County may obtain the written opinion of the Independent Engineer prepared in accordance with Section 5.5.4.1.
County Fault means the unexcused non-performance by the County of its obligations under this Agreement.

Examples of County Fault in a sentence

  • The project site does not lie within a State of California Earthquake Fault Hazard Zone (formerly called an Alquist‐Priolo Special Studies Zone) or the Riverside County Fault Zone.

  • The vast majority of the parcel is in the County Landslide Hazard Zone, and the County Fault Rupture Hazard Zone runs through the center of the lot (primarily located on proposed Parcel 1).

  • If the Scheduled Acceptance Date is subject to adjustment in accordance with this Section 5.5.3, the Scheduled Acceptance Date shall be extended by the number of days that the Manager can reasonably demonstrate to the County’s Authorized Representative are directly attributable to the effects of such County Fault.

  • The project site does not lie within a State of California Earthquake Fault Hazard Zone (formerly called an Alquist-Priolo Special Studies Zone) or the Riverside County Fault Zone.

  • The property is located in the County Landslide Hazard Zone and County Fault Rupture Zone.

  • The Manager shall cooperate fully with the County and coordinate the Work to such other County work as may be directed by the County, subject, as applicable, to the possibility of County Fault.

  • Preferred Alternative: Based upon the facts that there are no known faults within the project area, the site is not located within an Alquist-Priolo Special Studies Zone or County Fault hazard area, there is no fault rupture impact associated with this alternative.

  • The failure of the Manager to provide prompt Notice to the County may give rise to an adjustment to the relief to which the Manager might otherwise be entitled hereunder if and to the extent that such failure is reasonably determined to have increased the costs or delay caused by such County Fault.

  • The site does not lie within an Alquist-Priolo Earthquake Fault Hazard Zone as defined by the State of California in the Alquist-Priolo Earthquake Fault Hazard Zoning Act or a Riverside County Fault Zone.

Related to County Fault

  • Tight-fitting facepiece means a respiratory inlet covering that forms a complete seal with the face.

  • Loose-fitting facepiece means a respiratory inlet covering that is designed to form a partial seal with the face.

  • Septic tank means a watertight, accessible, covered receptacle designed and constructed to receive sewage from a building sewer, settle solids from the liquid, digest organic matter, store digested solids through a period of retention, and allow the clarified liquids to discharge to other treatment units for final disposal.

  • CT gantry means the tube housing assemblies, beam-limiting devices, detectors, and the supporting structures and frames which hold these components.

  • Storage tank means an aboveground storage tank or underground storage tank as defined by this Regulation.

  • Aboveground storage tank shall have the meaning ascribed to such term in Section 6901 et seq., as amended, of RCRA, or any applicable state or local statute, law, ordinance, code, rule, regulation, order ruling, or decree governing aboveground storage tanks.

  • Survey Area means the area of land or waters the subject of a Survey, or proposed to be the subject of a Survey.

  • Underground storage tank system means an underground storage tank and the connected underground piping, underground ancillary equipment, and containment system, if any.

  • Water surface elevation means the height, in relation to the National Geodetic Vertical Datum (NGVD) of 1929, the North American Vertical Datum (NAVD) of 1988, or other datum, where specified, of floods of various magnitudes and frequencies in the floodplains of riverine areas.

  • Underground storage tank or “UST” means any one or combination of tanks (including underground pipes connected thereto) that is used to contain an accumulation of regulated substances, and the volume of which (including the volume of underground pipes connected thereto) is 10 percent or more beneath the surface of the ground. This term does not include any:

  • Area of shallow flooding means a designated AO or AH Zone on a community's Flood Insurance Rate Map (FIRM) with one percent or greater annual chance of flooding to an average depth of one to three feet where a clearly defined channel does not exist, where the path of flooding is unpredictable and indeterminate; and where velocity flow may be evident. Such flooding is characterized by ponding or sheet flow.

  • Intersection means (i) the area embraced within the prolongation or connection of the lateral

  • Water Surface Elevation (WSE means the height, in relation to NAVD 1988, of floods of various magnitudes and frequencies in the floodplains of riverine areas.

  • Contractor Selection of Leave Trees means crop and leave trees are unmarked and will be selected by the Contractor.

  • 100-year floodplain means any area of land that:

  • Cooling Off Period Shall refer to the period of ten (10) calendar days commencing from and including the date of this Contract.

  • Floodplain or flood-prone area means any land area susceptible to being inundated by water from any source. See "Flood or flooding."

  • Crawling bug insecticide means any insecticide product that is designed for use against ants, cockroaches, or other household crawling arthropods, including, but not limited to, mites, silverfish or spiders. “Crawling Bug Insecticide” does not include products designed to be used exclusively on humans or animals, or any house dust mite product. For the purposes of this definition only:

  • manoeuvring area means that part of an aerodrome to be used for the take-off, landing and taxiing of aircraft, excluding aprons;

  • Area of special flood hazard means the land in the floodplain within a community subject to a one percent or greater chance of flooding in any given year.

  • Mine drainage means any drainage, and any water pumped or siphoned, from an active mining area or a post-mining area. The abbreviation “ml/l” means milliliters per liter.

  • CAFRA Centers, Cores or Nodes means those areas with boundaries incorporated by reference or revised by the Department in accordance with N.J.A.C. 7:7-13.16.

  • AT&T MIDWEST REGION 5-STATE means the AT&T owned ILEC(s) doing business in Illinois, Indiana, Michigan, Ohio and Wisconsin.

  • Drainage system means one or more artificial ditches, tile drains or similar devices which collect surface runoff or groundwater and convey it to a point of discharge.

  • Flooding means a volume of water that is too great to be confined within the banks or walls of the stream, water body, or conveyance system and that overflows onto adjacent lands, thereby causing or threatening damage.

  • Excavation zone means the volume containing the tank system and backfill material bounded by the ground surface, walls, and floor of the pit and trenches into which the UST system is placed at the time of installation.
