Section 4.6.2. The Union may not continue to advise the employees on courses of action after the employee has 28 indicated a desire not to pursue a complaint or grievance.
Section 4.6.2. 42 Union members requesting to rescind membership and membership rights in their exclusive 43 advocacy organization shall make such request in writing to PSE/SEIU 1948, following the 44 Constitution and Bylaws, and any and all relevant conditions, policies and procedures. 45 46 Providing such conditions have been met, PSE/SEIU 1948 shall inform the District and local 47 chapter of the employee’s non-member status.

Section 4.6.2. The Government of the United States and the Government of the Republic of the Xxxxxxxx Islands previously have concluded agreements, which shall remain in effect and shall survive in accordance with their terms, as follows:
Section 4.6.2. 35 The names, work assignments, work locations and days worked by temporary employees, (as 36 defined in Section 9.11.1 and Section 10.7) shall be provided to the Union, upon request.
Section 4.6.2. In the event that an Erroneous Payment (or portion thereof) is not recovered by the Administrative Agent for any reason, after demand therefor by the Administrative Agent in accordance with the preceding clause (a) above, from any Lender that has received such Erroneous Payment (or portion thereof) (and/or from any Payment Recipient who received such Erroneous Payment (or portion thereof) on its respective behalf) (such unrecovered amount, an “Erroneous Payment Return Deficiency”), upon the Administrative Agent’s notice to such Lender at any time, then effective immediately (with the consideration therefor being acknowledged by the parties hereto), (i) such Lender shall be deemed to have assigned its Loans (but not its Commitments) with respect to which such Erroneous Payment was made (the “Erroneous Payment Impacted Loans”) in an amount equal to the Erroneous Payment Return Deficiency (or such lesser amount as the Administrative Agent may specify) (such assignment of the Loans (but not Commitments) of the Erroneous Payment Impacted Loans, the “Erroneous Payment Deficiency Assignment”) (on a cashless basis and such amount calculated at par plus any accrued and unpaid interest (with the assignment fee to be waived by the Administrative Agent in such instance)), and is hereby (together with the Borrower) deemed to execute and deliver an Assignment and Assumption with respect to such Erroneous Payment Deficiency Assignment, and such Lender shall deliver any Notes evidencing such Loans to the Borrower or the Administrative Agent (but the failure of such Person to deliver any such notes shall not affect the effectiveness of the foregoing assignment), (ii) the Administrative Agent as the assignee Lender shall be deemed to have acquired the Erroneous Payment Deficiency Assignment, (iii) upon such deemed acquisition, the Administrative Agent as the assignee Lender shall become a Lender, as applicable, hereunder with respect to such Erroneous Payment Deficiency Assignment and the assigning Lender shall cease to be a Lender, as applicable, hereunder with respect to such Erroneous Payment Deficiency Assignment, excluding, for the avoidance of doubt, its obligations under the indemnification provisions of this Agreement and its applicable Commitments which shall survive as to such assigning Lender, (iv) the Administrative Agent and the Borrower shall each be deemed to have waived any consents required under this Agreement to any such Erroneous Payment Deficiency Assig...

  • Section 3.4 26 Each employee reserves and retains the right to delegate any right or duty contained in this Agreement, 27 exclusive of compensation for services rendered, to appropriate officials of the Association.

  • Section 6.2 13 The Association representatives may represent the Association and employees in meeting with officials 14 of the District to discuss appropriate matters of mutual interest. They may receive and investigate to 15 conclusion complaints or grievances of employees on District time and thereafter advise employees of 16 rights and procedures outlined in this Agreement and applicable regulations or directives for resolving 17 the grievances or complaints. They may not, however, continue to advise the employee on courses of 18 action after the employee has indicated a desire not to pursue a grievance.   • Section 4.4 32 The Association reserves and retains the right to delegate any right or duty contained herein to 33 appropriate officials of the Public School Employees of Washington/SEIU Local 1948 State 34 Organization.

  • Section 3.5 45 Neither the District, nor the Association, shall discriminate against any employee subject to this 46 Agreement on the basis of race, creed, color, sex, religion, age or marital status or because of a physical 1 handicap with respect to a position, the duties of which may be performed efficiently by an individual 2 without danger to the health or safety of the physically handicapped person or others.
