Funds may not be immediately available for you to withdraw and may not increase your Current Balance under some circumstances. Credit given by us to you with respect to an ACH or direct deposit credit Item (such as your pay from your employer or benefits from any federal or state government) is a Provisional Credit and we may decide to give you Provisional Credit for the deposit and allow you to withdraw funds from your Account before we receive Final Settlement for such deposit through a Federal Reserve Bank. In the event we do allow you to withdraw funds Posted as a Provisional Credit and we do not receive Final Settlement, you agree that we are entitled to a refund by you of the amount credited to your Account in connection with such entry. If we do not receive a Final Settlement through a Federal Reserve Bank or any such deposit is required, for any reason, to be returned to the original sender, you agree that we are entitled to (i) return the deposit to the original sender, such as your employer or any agency or department of the government and (ii) a refund from you of all amounts provisionally credited to your Account in connection with such Item. In order to effectuate any refund from you to which we are entitled under this provision, you authorize us without prior notice to you (except where prior notice is required by applicable law) to deduct the amount of the deposit from the Account into which it was credited or from any other Account you have with us. We may also use any other legal remedy to recover from you the amount returned. IN SUCH CIRCUMSTANCES YOU AGREE THAT YOU SHALL INDEMNIFY AND HOLD US HARMLESS FROM ALL CLAIMS, DEMANDS, LAWSUITS, LOSSES, COSTS, EXPENSES AND ATTORNEYS’ FEES WE SUFFER OR INCUR IF EXERCISING OUR RIGHT OF RECLAMATION RESULTS IN INSUFFICIENT FUNDS IN THE ACCOUNT OR OTHER ACCOUNTS.
