Night Depository Sample Clauses
Night Depository. If you use any of the Bank’s night depositories, you do so solely at your own risk. The Bank is not liable for any deposit made into a night depository until the Bank issues you a duplicate deposit ticket or other receipt acknowledging the deposit. The Bank’s determination of the amount of the deposit will be conclusive. You are solely responsible for any discrepancy in the amount of the deposit or any loss incurred from the disappearance, theft, or loss of any envelope, bag, or money before the Bank issues you a written receipt for the deposit.
Night Depository. If ATB Financial allows you to use the night depository at the branch at which you opened the Account (“Depository”), you agree with ATB Financial as follows:
(a) Only Canadian and/or U.S. currency, cheques, money orders, bank drafts and other orders for the payment of shall be placed in the depository. These items shall be sealed in a tamper proof disposable plastic bag supplied by ATB Financial, and the door of the Depository shall be closed and locked. You acknowledge receipt from ATB Financial of a key to the outside door of the Depository, which shall remain the property of ATB Financial. You shall immediately notify ATB Financial of any loss of the key to the outside door of the Depository and you are responsible for all costs of a new lock(s) and key(s) if ATB Financial chooses, at its sole discretion, to replace them.
(b) You will be responsible for the purchase of tamper proof bags from ATB Financial, at a price set by ATB Financial, from time to time.
(c) When the Depository is used for deposit(s) and/or xxxx payment(s), the original completed ATB Financial deposit form(s) and/or original remittance portion(s) along with cheque(s) payable from the Account, shall be securely enclosed in the bag. ATB Financial shall open the bag, remove the contents, and deal with those contents in accordance with its usual business practices. Until the contents have been dealt with by ATB Financial, the contents are considered as not processed through the Account.
(d) Upon termination of this Agreement you shall deliver any/all keys supplied by ATB Financial. If same are not returned or have been subject to more than normal wear and tear, you are liable for the item(s) and all costs associated with repairing or replacing those items.
Night Depository. For business members who have requested and we have arranged for night depository services, the following requirements apply. You agree to properly place deposit items securely in our night depository facility. You agree to assume full responsibility for placing your deposit items in the night depository. You agree to hold harmless the Credit Union if you or your agent fails to conform to all terms applicable to the night depository service.
Night Depository. The Employer will provide a night depository or make other arrangements so that Drivers will not be required to keep money collected overnight.
Night Depository. The Bank will open the night deposit bag or envelope placed in the night depository on the next banking day following the night of deposit. The night deposit bag or envelope should contain a deposit slip that correctly lists the money, check, draft or other items included in the deposit. The Bank will verify the deposit and credit to the account the amount of the deposit actually received, in accordance with the Bank’s Funds Availability Policy. If there is any discrepancy between the amount of the deposit as shown on the deposit slip and the amount of the deposit actually received, Bank will notify customer of such discrepancy. No relationship of debtor or creditor shall arise between customer and the bank until we open the package and credit the deposit to customer’s account. We will only be liable for the deposit actually received and credited to your account. The joint findings and records of any two employees of the Bank as to the presence or absence of any package in the night depository and as to the contents of the package shall be conclusive and binding upon you. Customer agrees that the use of the night depository is at its sole risk to the extent permitted by law. We will not be responsible for any loss or damage sustained in the use of the night depository resulting from any cause whatsoever, including mechanical defects or a malfunction of the facility itself, unless such damage is caused by our gross negligence. We will not be liable for damages resulting from causes beyond our control. In no event will we be an insurer of the contents of the night deposit bag or envelope deposited by customer in the night depository.
Night Depository. For business members who have requested and we have arranged for night depository services, following requirements apply. You agree to use the night depository bag, envelope or container we furnish and to use the container only for deposits made with the Credit Union. You agree to properly place containers securely in our night depository facility. You agree to assume full responsibility for placing your deposit items or property in containers other than those we furnish and for failing to conform to all terms applicable to the night depository service. You agree that our liability of the night depository service is that of a bailee of night depository containers and their contents. We are a bailee until the containers are opened and we verify and credit the contents to your account or until you have signed a receipt for and accepted custody of the containers.
Night Depository. If you use our night depository, you are responsible for any disappearance, theft or loss of any envelope, bag or other item. You may not deposit cash through our night depository. Any of our employees may open and process any deposit, and you agree that our determination of the amount that you deposited shall be final.
Night Depository. The Credit Union reserves the right to supply and require the use of a special bag or container for any deposits in the night depository. If we do supply a special bag or container, you will be liable for any damage to the night depository or delay in crediting deposits due to the use of containers other than those we supply. You agree that we are a bailee of items placed in the night depository until we have opened the containers, verified the contents, and credited the contents to your account or returned the bag and contents to you.
Night Depository. If you arrange for night depository services, you must also comply with the following two rules and also comply with the rules in any separate night depository agreement.
