Availability of Deposits. The availability of funds in your account in connec- tion with a deposit may be delayed as set out more fully in the Funds Availability Policy Disclosure.

An Image that is successfully presented to us prior to any business day cutoff time, will be consider the date of your Deposit and if presented after such cutoff time, the next day will be the date of your Deposit. Deposits made through the Mobile Deposit Services are available based on the Funds Availability Policy set forth below and, despite being made through the Mobile Deposit Services, will not be subject to the funds availability requirement of Federal Reserve Board Regulation CC even if we provide you with Regulation CC disclosures or notices. Further, for any Image you submit for us to process through the Mobile Deposit Services, we have the right to place an extended hold on the related Deposit with notice to you. If we do extend a hold on any Deposit, we will let you know when the Deposit will be available for withdrawal. In determining whether to extend a hold on any large Deposit, you agree that we may include in our consideration any Deposits you have made using the Mobile Deposit Services.

Availability of Deposits. For determining the availability of your deposits, every day is a business day, except Saturdays and Sundays. If you make a deposit before 2:00 p.m. (ET) on a business days, we may consider that day to be the day of your deposit. However, if you make a deposit after 2:00 p.m. (ET) or a non-business day, we may consider that the deposit was made on the next business day.
Availability of Deposits. If, after Borrower has elected to borrow or maintain any Loan at LIBOR, Lender notifies Borrower that:
(i) United States dollar deposits in the amount and for the maturity requested are not available to Lender in the London interbank market; or
(ii) Reasonable means do not exist for Lender to determine LIBOR for the amount and maturity requested, all as determined by the Lender in its sole discretion, then the principal subject or to be subject to LIBOR shall accrue or shall continue to accrue interest at the Prime-Based Rate.
