DAC6 definition

DAC6 means the Council Directive of 25 May 2018 (2018/822/EU) amending Directive 2011/16/EU.

DAC6 means the Council Directive of 25 May 2018 (2018/822/EU) amending Directive 2011/16/EU as regards mandatory automatic exchange of information in the field of taxation in relation to reportable cross-border arrangements as amended and any regulation or law relating to, implementing or having similar effect to it in any relevant jurisdiction;

DAC6 means the Council Directive 2011/16/EU, as amended by Council Directive (EU) 2018/822 on Administrative Cooperation (as implemented in Luxembourg, the Netherlands and/or Belgium).

DAC6 was required to be transposed by each EU member state by the end of 2019 with the measures taking effect from 1 July 2020.
Based on the current legislation, no transactions are undertaken by the Fund that could be considered a reportable cross-border arrangement under DAC6.
However, it cannot be excluded that, transactions undertaken by the Fund or Investors may be considered reportable cross-border arrangements under DAC6.
DAC6 imposes mandatory reporting requirements on EU-based intermediaries who design, market, organise, make available for implementation or manage the implementation of potentially aggressive cross-border tax-planning schemes.

Nothing in any Security Document shall prevent disclosure of any confidential information or other matter to the extent that preventing that disclosure would otherwise cause any transaction contemplated by the Security Documents or any transaction carried out in connection with any transaction contemplated by the Security Documents to become an arrangement described in Part II A 1 of Annex IV of Directive 2011/16/EU;

DAC6 means Annex IV of the Council Directive of 25 May 2018 (2018/822/EU) amending Directive 2011/16/EU (“DAC6”).

DAC6 shall have the meaning specified in paragraph 8L.
