Damage Claims shall be limited to amounts owed by the Grantor pursuant to: (i) claims resolved and settled by the GCCF (“GCCF Claims”); (ii) amounts owed by the Grantor pursuant to final judgments or settlement agreements that are resolved outside of the GCCF process and relate to the Oil Spill (“Other Resolved Claims”); (iii) natural resource damage costs (including assessment costs) pertaining to the Oil Spill (“NRD Claims”); and (iv) state and local government response costs pertaining to the Oil Spill (“Government Response Costs”). Notwithstanding the foregoing, Damage Claims shall not include the amounts for any fines and penalties or the amounts of any claims by partners, subsidiaries, affiliates, shareholders, noteholders, customers, operators or suppliers of the Grantor or its affiliates in their capacity as such.
Damage Claims means and refer to Xxxxxxxxx’ claims for the Property Damage Remedy.
Damage Claims mean all claims for damages against Quadrat and Sycamore, its shareholders and managing directors, employees and whoever was involved in this respect in the unlawful capital raise of the Company and subsequent management decisions related to the Company, the Trustor and the founders of the Company according to the subscription agreement.

Damage Claims. Any claims for loss, damage or delay to Commodity shipments shall be governed by the same provisions contained in 49 USC ss.11706 and 49 CFR ss.1005.

  • Released PAGA Claims means the claims being released as described in Paragraph 6.2 below.

However, any dispute or argument that concerns the validity or enforceability of the Agreement as a whole is for the arbitrator, not a court, to decide.

  • DIP Claims means, collectively, the DIP ABL Claims and the DIP Term Loan Claims.

  • Severe property damage means substantial physical damage to property, damage to the treatment facilities which would cause them to become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production.

  • Prior Claims means the Competing Claims to which the Authority’s right to the Building Aid is subordinated by the School Financing Act.
