The preceding exclusion does not apply to expansion within the extended corridor as contemplated by the expansion project of the easement for the corridor under the DBP Act which was occurring at or about 27 October 2004.
Expansion means all work required to be undertaken to or in connection with the DBNGP in order to expand the Gas Transmission Capacity of the DBNGP, including to provide additional Capacity for Alcoa pursuant to the Alcoa Exempt Contract, but excluding (subject to the following sentence) any expansion which causes the DBNGP to exceed the geographical confines of the DBNGP Pipeline Corridor created under Part 4 of the DBP Act as at the date of this Contract.
DBNGP means the Gas transmission pipeline system that runs between Dampier and Bunbury in Western Australia, described in section 2 of the Access Arrangement (as approved for the period 2021 – 2025) as expanded or amended from time to time to the extent that it is geographically located within the DBNGP Pipeline Corridor created under Part 4 of the DBP Act, as that Corridor exists at 1 January 2021.

During the period 2015 to 2018, Icon constructed the Building and during this period engaged in 'construction work' within the meaning of that term as defined in s 36(1) of the DBP Act.
This clause 6.6 of Schedule 3 (other than this sentence) applies only to the extent that the DBP Act and the DBP Regulation applies to the Developer’s Works.

By reason of s 37(1) of the DBP Act, Icon, as the builder of the Building, had a duty, when constructing the Building, to exercise reasonable care to avoid economic loss caused by defects: (a) in or related to the Building (it being the building for which Icon’s construction work was done); and (b) arising from the construction work carried out by Icon.
