Delivery Contractor definition

Delivery Contractor means third parties under contract with Buyer to deliver, on its behalf, any Products to Home Heat Business end customers and to whom Buyer sublicenses the Marks, on the terms and conditions set forth in this Home Heat TLA.

  • Delivery: Contractor shall deliver the software via (select one) digital download/ physical media.

  • If Buyer or its defaulting Delivery Contractor fails to cure any breach within the required cure period, then at the expiration of the relevant cure period, or at any time thereafter upon written notice to Buyer prior to the date on which the breach is actually cured, Seller may permanently terminate the Home Heat License with respect to the relevant Delivery Contractor.

  • Delivery: Contractor MUST inspect all garments thoroughly before shipment to State Agencies.

  • To earn the performance-based Contract term extension, Contractor must achieve the following performance-based metrics: Performance Metric Performance Requirement for Contract Extension Timely Delivery: Contractor must timely deliver Water Treatment Products ordered by Purchasers such that, on an aggregate basis, Contractor delivers within the specified delivery window for at least 97% of all Orders.

  • To earn the performance-based Contract term extension, Contractor must achieve the following performance-based metrics: Performance Metric Performance Requirement for Contract Extension Delivery: Contractor must complete the delivery of goods within ninety (90) calendar days from the date which the order is placed, as described in § 8.2 of this Contract.

  • Prior to asking Customer to accept any Deliverable Items and prior to Delivery, Contractor shall, subject to Paragraph 7.2 below, certify, in writing, in the form set forth in Attachment 10, that the Deliverable Items conform to all Contract requirements.

Related to Delivery Contractor

  • Supplier/Contractor means the individual, firm or company with whom the contract has been concluded for supplying the Goods and Services under the Contract. The Supplier/Contractor shall be deemed to include its successors (approved by the purchaser), representatives, heirs, executors, administrators and permitted;

  • O&M Contractor means the person, if any, with whom the Concessionaire has entered into an O&M Contract for discharging O&M obligations for and on behalf of the Concessionaire;
