Diagnostics Field definition

Diagnostics Field means in vitro testing for research use, or exploratory use, or as a clinical diagnostic for use in the diagnosis or on-going evaluation of a disease or medical condition, including the prediction or monitoring of a response to a therapeutic agent, selection for therapy and also use as an in vitro diagnostic.
Diagnostics Field. 1.28 means the discovery, development, manufacture, and/or sale of laboratory developed tests, or in vitro diagnostic tests for research, clinical or medical use or as a diagnostic to identify the presence of a human disease or condition, predict development of a human disease or condition, monitor likelihood of patient response to an intervention or as a prognostic of a human disease or condition.
Diagnostics Field means all applications for the [Confidential Treatment Requested] in connection with the diagnosis and treatment of disease in humans, including but not limited to diabetes and complications of diabetes; however currently available, whether through publication or commercialization, invasive diagnostics applications are not included within the definition of Diagnostics Field.

Diagnostics Field means in-vitro products, devices, reagents, components, systems, applications, software and/or assays for clinical use, including without limitation diagnostic and prognostic tests, in each case that may require a premarket clearance or approval, including a 510k, ASR (provided that Catalyst may not sell an ASR product that is identical in formulation to one of Agilent’s cataolog products), or PMA, from the Federal Food and Drug Administration or a foreign equivalent governing body, or that is manufactured under and in compliance with Quality Systems Regulations governing the manufacture of in-vitro diagnostics and/or devices, before the same may enter the stream of commerce, but excluding the fields of urinalysis, autoimmune and allergy testing.
Diagnostics Field means in-vitro testing for exploratory use or as a clinical diagnostic solely for use in-vitro in the diagnosis and/or on-going evaluation of a disease or medical condition, including the prediction and/or monitoring of a response to a therapeutic agent, and also use as an IVD.
