Commercial Purposes definition

Commercial Purposes means any commercial or profit generating purpose including the sale, lease of other transfer of the Material and includes uses of the Material by any organisation, including Recipient, to perform contract research, to produce or manufacture products for general sale, or to conduct research activities that result in any sale, lease, license, or transfer of the Material.

Commercial Purposes means to advance a person’s commercial or economic interests, such as by inducing another person to buy, rent, lease, join, subscribe to, provide, or exchange products, goods, property, information, or services, or enabling or effecting, directly or indirectly, a commercial transaction. “Commercial purposes” do not include for the purpose of engaging in speech that state or federal courts have recognized as noncommercial speech, including political speech and journalism.

• We grant you a non-assignable, non-sublicensable, non- exclusive, worldwide right and license for one Authorized User to install the Software on one (1) Machine which may be restricted to a Desktop/Workstation or Server or in other ways as communicated by us to you on the website and internally use the Software for Commercial purposes.

• Commercial purposes, including but not limited to generating revenue, business operations, product development, or paid services.

• We grant you a non-assignable, non-sublicensable, non-exclusive, worldwide right and license to internally use and install the Software on the number of Server(s) listed in the Order Form for Commercial purposes.

More Definitions of Commercial Purposes

Commercial Purposes means the ordinary purposes of trade, agriculture, industry, and commerce, exclusive of the practices of medicine and pharmacy.

However, industrially sponsored academic research shall not be considered a use of the MATERIAL or MODIFICATIONS for COMMERCIAL PURPOSES per se, unless any of the above conditions of this definition are met.

Commercial Purposes. The sale, lease, license, or other transfer of the Material or Modifications to a for-profit organi- zation. Commercial Purposes shall also include uses of the Material or Modifications by any organization, including Recipient, to perform contract research, to produce or manufacture products for general sale, or to conduct research activities that result in any sale, lease, license, or transfer of the Material or Modifications to a for-profit organization. However, industrially sponsored aca- demic research shall not be considered a use of the Material or Modifications for Commercial Purposes per se, unless any of the above conditions of this definition are met. For the avoidance of doubt, the Parties acknowledge and agree that the following shall not be a Commercial Purpose as defined herein: (i) sending the Materials to a third party where that third party is required for the rederivation and/or breeding of live mice from the Materials on the Recipient’s behalf; and/or (ii) use a third party to import the Materials into the Recipient’s country on the Recipient’s behalf, both (i) and (ii) as specified in Annex 1. The third parties mentioned in the preceding sentence shall be referred to as “Third Party Agents”.

Commercial Purposes means taking food fish with any gear unlawful for angling, or taking or possessing food fish in excess of the limits permitted for personal use, or taking, fishing for, handling, processing, or otherwise disposing of or dealing in food fish with the intent of disposing of such food fish or parts thereof for profit, or by sale, barter or trade, in commercial channels.
