In particular, if: Buyer does not issue a Confirmation Notice within five (5) business days of completing Preliminary Inspection of the Aircraft (or a longer period agreed in writing by Seller and Buyer), then Escrow Agent shall refund to Buyer the Deposit; or Seller receives a Discontinuation Notice (as defined in Section 2.6(b)), Escrow Agent shall refund to Buyer the Deposit.
