Any disclosure(s) of CMS Data, or any individually-identifiable derivative of this CMS Data, by the undersigned or its agents to a Downstream User, as defined below, shall be made in accordance with applicable law as well as any applicable provisions in this or other governing documents.
It may be that the Seller is the Downstream User, in which case the Product will be registered by the supplier to the Seller.
Besides, the CONCESSIONAIRE and the Downstream User shall comply with all the Applicable Laws, related to the equitable availability and equality of prices and Rates of Assets and/or services and the reasonable, non-discriminatory access to the Airport in equal circumstances.
However if the Customer intends to acquire the Deliverables for use(s) other than the ones registered by the Supplier and/or by its sub-suppliers, or as notified by the Customer itself as provided for above, then the Customer undertakes to comply with the related Downstream User obligations set forth in Art.37 of REACH Regulation.
Any disclosure(s) of this CMS Data, or any derivative of this CMS Data, by the undersigned or its agents to a Downstream User, as defined below, shall be made in accordance with applicable law and the prior written approval of CMS, and must be preceded by the User’s execution of a Data Use Agreement, a copy of which is attached hereto as Attachment A.
