The Directive requires that EIA development must be subject to a development consent process.
In accordance with the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999, the County Council has conducted a “Screening Opinion” on the proposals which concluded that the proposed development is not EIA development and therefore need not be supported by an Environmental Statement.
As required by regulation 5(4)(c), where a relevant planning authority has to decide whether Schedule 2 development is EIA development, they must take into account the selection criteria set out in Schedule 3 as are relevant to the development.

Overall, it is considered that the proposal falls outside of the formal definition of EIA development and therefore an EIA would not be required.
