Eligible Private Assets definition

Eligible Private Assets. Eligible Public Equities”, “Eligible Brand Assets”, “Eligible Consumer Receivables Assets”, “Asset Value”, “Qualified Cash” and “Excess Concentration Reduction”) without the consent of Lenders having Total Credit Exposures representing more than 66 2/3% of the Total Credit Exposures of all Lenders (disregarding the Total Credit Exposure of any Defaulting Lender);
Eligible Private Assets means (x) all Public Equities that would be “Eligible Public Equities” but for the application of clauses (d) and/or (e) of the definition thereof and (y) all Private Assets of a Borrowing Base Loan Party reflected in the most recently delivered Borrowing Base Certificate, except in the case of this clause (y), Private Assets with respect to which any of the exclusionary criteria set forth below applies (except in the case of an applicable Approved Asset). No Private Asset described in clause (y) shall be an Eligible Private Asset if (except in the case of an applicable Approved Asset):
Eligible Private Assets means all Private Assets of a Borrowing Base Loan Party reflected in the most recently delivered Borrowing Base Certificate, except Private Assets with respect to which any of the exclusionary criteria set forth below applies (except in the case of an applicable Approved Asset). Examples of Eligible Private Assets in a sentence

  • The Administrative Agent may rely, in determining which Credit Assets are Eligible Credit Assets (or Eligible Subordinated Credit Assets or Eligible First Lien Credit Assets), Private Assets are Eligible Private Assets and Public Equities are Eligible Public Equities on all statements and representations made by the Loan Parties in respect of such Credit Assets, Private Assets and Public Equities.

  • Eligible Property means property beneficially owned by a person or entity other than the Fund and held in a bank account maintained by BNYM for or on behalf of the Fund, or property held in a Fund shareholder account, which is (x) subject to reporting or escheat under an Unclaimed Property Law, (y) of a nature or type or classification reasonably related to the services performed by BNYM under this Agreement (such as cash amounts representing non-negotiated dividend checks and shares in abandoned shareholder accounts), and (z) under the control of BNYM.

  • Eligible project means 1 or more of the following projects of a local unit that have been approved by the director and the state treasurer, including costs associated with a project necessary for issuance of evidences of indebtedness to finance the project:

  • newly rateable property means any rateable property on which property rates were not levied before the end of the financial year preceding the date on which this Act took effect, excluding –

  • Real Estate Assets means any investment by the Company or the Operating Partnership in unimproved and improved Real Property (including fee or leasehold interests, options and leases), directly, through one or more subsidiaries or through a Joint Venture.

  • Real Estate Asset means, at any time of determination, any interest (fee, leasehold or otherwise) then owned by any Credit Party in any real property.

  • Motor home means every private motor vehicle with a normal seating capacity of not more than 10

  • Qualifying medical condition means seizure disorder,

  • Qualifying Notes means, at any time, any securities (other than the Notes) issued directly or indirectly by the Issuer:

  • Undepreciated Real Estate Assets as of any date means the cost (original cost plus capital improvements) of real estate assets of the Company and its Subsidiaries on such date, before depreciation and amortization, determined on a consolidated basis in accordance with GAAP.

  • Borrowing Base Assets means a collective reference to all Borrowing Base Assets in existence at any given time.

  • Qualified Property has the meaning set forth in Section 313.021(2) of the TEXAS TAX CODE and as interpreted by the Comptroller’s Rules and the Texas Attorney General, as these provisions existed on the Application Review Start Date.

  • Qualifying Equity Interests means Equity Interests of the Company other than Disqualified Stock.

  • Qualifying Property means a primary residence that a qualified applicant owned and occupied

  • Stored value means monetary value that is evidenced by an electronic record.

  • Applicant’s Qualified Property means the Qualified Property of the Applicant to which the value limitation identified in the Agreement will apply and as more fully described in EXHIBIT 4 of this Agreement.

  • Asset-backed security means a security that is primarily serviced by the cash flows of a discrete pool of mortgages, receivables or other financial assets, fixed or revolving, that by their terms convert into cash within a finite period and any rights or other assets designed to assure the servicing or the timely distribution of proceeds to securityholders;
