Employer or Agency definition

Employer or Agency means any civil agency or instrumentality of the United States Government, or any other organization, group or institu- tion employing an individual defined as an ‘‘employee’’ by this section. These terms also refer to officers and employ- ees of an employer having responsi- bility for the supervision, direction or control of employees of that employer as an ‘‘immediate superior,’’ and to other employees designated by the em- ployer to carry out the functions vest- ed in the employer under the FECA and this part, including officers or employ- ees delegated responsibility by an em- ployer for authorizing medical treat- ment for injured employees.

Examples of Employer or Agency in a sentence

  • The notification to employees covered by this Agreement by the Union shall be made at the request of the Employer or Agency.

  • Upon notification, confirmed in writing by the Employer or Agency to the Union that certain bargaining unit employees covered by this Agreement are engaging in strike activity in violation of this Article, the Union shall, upon receipt of a mailing list, advise such striking employees in writing, with a copy to the Employer and Agency, to return to work immediately.

  • The Union agrees that during the life of this Agreement, the Union or its bargaining unit employees will not authorize, instigate, aid or engage in any work stoppage, slowdown, sickout, refusal to work, picketing or strike against the Employer or Agency, its goods or on its property.

  • The Union agrees that it will indemnify, defend and save the Employer and Agency harmless from all suits, actions, proceedings, and claims against the Employer and the Agency or persons acting on behalf of the Employer and Agency for actions taken or not taken by the Employer or Agency whether for damages, compensation, reinstatement, or combination thereof arising out of the Agency’s implementation of this Article.

  • Any non-competition contract litigation with a prior Employer or Agency.

  • This Agreement is made and entered into by and between the Lake County Narcotics Agency, Lake County, Ohio (hereinafter referred to as the Employer or Agency), and the Ohio Patrolmen’s Benevolent Association, (O.P.B.A.), representing the Narcotics Agents (hereinafter referred to as the Agents or Bargaining Unit employees).

  • Health facility or agency means that term as defined in section 20106 of the public health code, 1978 PA 368, MCL 333.20106.

  • Public employer means the State of Oregon, and the following political subdivisions:

  • Solicitation of a romantic relationship means deliberate or repeated acts that can be reasonably interpreted as the solicitation by an educator of a relationship with a student that is romantic in nature. A romantic relationship is often characterized by a strong emotional or sexual attachment and/or patterns of exclusivity, but does not include appropriate educator-student relationships that arise out of legitimate contexts such as familial connections or longtime acquaintance. The following acts, considered in context, may constitute prima facie evidence of the solicitation by an educator of a romantic relationship with a student:

  • Employing agency means a division, department, or separate

  • School employer means a board of school directors, the

  • Participating agency means any LEA, agency or institution that collects, maintains, or uses personally identifiable information, or from which information is obtained, under Part B of the IDEA.

  • Personal relationship means an ongoing romantic or intimate personal relationship that can include, but is not limited to, dating, living together or being a partner or significant other. This definition applies regardless of gender, gender identification, or sexual orientation of the individuals in the relationship. This restriction does not extend to friends, acquaintances or former colleagues who are not otherwise encompassed in the scope of “personal relationships.”

  • Participating Agencies means members of National Purchasing Partners for which Vendor has agreed to extend the terms of this Master Price Agreement pursuant to Article 2.6 and Attachment C herein. For purposes of cooperative procurement, “Participating Agency” shall be considered “Purchaser” under the terms of this Agreement.

  • Related Employer means the Employer and (a) any corporation that is a member of a controlled group of corporations as defined in Code Section 414(b) that includes the Employer and (b) any trade or business that is under common control as defined in Code Section 414(c) that includes the Employer.

  • Public school employer means a public employer that is the board of a school district, intermediate school district, or public school academy; is the chief executive officer of a school district in which a school reform board is in place under part 5A of the revised school code, 1976 PA 451, MCL 380.371 to 380.376; or is the governing board of a joint endeavor or consortium consisting of any combination of school districts,

  • Public health emergency means an emergency with respect to COVID–19 declared by a Federal, State, or local authority.

  • Flood fringe means the portion of the floodplain outside the floodway that is usually covered with water from the 100-year flood or storm event. This includes, but is not limited to, the flood or floodway fringe designated by the Federal Emergency Management Agency.

  • Awarding agency means (a) with respect to a grant, cooperative agreement, or cost reimbursement contract, the Federal agency, and (b) with respect to a subaward, the party that awarded the subaward.

  • Predecessor Employer means the South Shore District Health Authority, South West Nova District Health Authority, Annapolis Valley District Health Authority, Colchester East Hants Health Authority, Cumberland Health Authority, Pictou County Health Authority, Guysborough Antigonish Strait Health Authority, Cape Breton District Health Authority and Capital District Health Authority.

  • Enrolled Nurse means an employee:

  • Affiliated Employer means any corporation which is a member of a controlled group of corporations (as defined in Code Section 414(b)) which includes the Employer; any trade or business (whether or not incorporated) which is under common control (as defined in Code Section 414(c)) with the Employer; any organization (whether or not incorporated) which is a member of an affiliated service group (as defined in Code Section 414(m)) which includes the Employer; and any other entity required to be aggregated with the Employer pursuant to Regulations under Code Section 414(o).

  • Expert advice or assistance means advice or assistance derived from scientific, technical, or other specialized knowledge.

  • Professional employer organization means an employee leasing

  • Eligible educational institution means that term as defined in section 529 of the internal revenue code or a college, university, community college, or junior college described in section 4, 5, or 6 of article VIII of the state constitution of 1963 or established under section 7 of article VIII of the state constitution of 1963.

  • Academic employee Academic employee shall mean an employee in the Professional Services Negotiating Unit with academic or qualified academic rank.

  • Employer as defined in Section 3(5) of ERISA.

  • Service agency means the public agency, the State or any local government unit or special purpose district which has the authority to provide police, fire fighting, medical or other emergency services, which has requested the local telephone company to provide an E911 Telecommunications Service for the purpose of voice-reporting emergencies by the public.

  • Home Health Care Agency means an agency or organization which provides a program of home health care and which:

  • Supervising agency means an agency licensed by the state

  • affiliated college means an educational institution affiliated to the University but not maintained or administered by it;

  • Sending agency means a party state, officer or employee thereof; a subdivision of a party state, or officer or employee thereof; a court of a party state; a person, corporation, association, charitable agency or other entity which sends, brings, or causes to be sent or brought any child to another party state.
