Environmental Cleanup Liability definition

Environmental Cleanup Liability means any cost or expense of any nature whatsoever incurred to contain, remove, remedy, clean up, or xxxxx any contamination or any Hazardous Materials on or under all or any part of the Property, including the ground water thereunder, including, without limitation, (A) any direct costs or expenses for investigation, study, assessment, legal representation, cost recovery by governmental agencies, or ongoing monitoring in connection therewith and (B) any cost, expense, loss or damage incurred with respect to the Property or its operation as a result of actions or measures necessary to implement or effectuate any such containment, removal, remediation, treatment, cleanup or abatement.
Environmental Cleanup Liability means any cost or expense of any nature whatsoever incurred to contain, remove, remedy, clean up, or abate any contamination or any Hazardous Materials on or under all or any part of the Property, including the ground water hereunder, including, without limitation, (i) any direct costs or expenses for investigation, study, assessment, legal representation, cost recovery by governmental agencies, or ongoing monitoring in connection therewith and (ii) any cost, expense, loss or damage incurred with respect to the Property or its operation as a result of actions or measures necessary to implement or effectuate any such containment, removal, remediation, treatment, cleanup or abatement.
Environmental Cleanup Liability means any cost or expense incurred to investigate, monitor, remove, remediate, treat, clean up, xxxxx or otherwise respond to any Release or threatened Release of Hazardous Materials, including, without limitation , the cost of obtaining Site closure from applicable governmental agencies and the cost of restoring the affected property upon completion of responsive action.

  • Should the Lessor's investigations undertaken during the Environmental Due Diligence Period provided under this Lease reveal that Lessee has caused or created any adverse environmental conditions or Hazardous Materials upon the Premises during the Term of this Lease, the Lessee shall reimburse Lessor for all Environmental Cleanup Liability, including any and all costs of remediating such conditions as are necessary to prepare the Premises for the development of the Cherry Avenue Project.

Environmental Cleanup Liability shall have the meaning defined in the Assumption and Indemnification Agreement.
