Environmental Costs definition

Environmental Costs any and all costs or expenses (including attorney’s and consultant’s fees, investigation and laboratory fees, response costs, court costs and litigation expenses, fines, penalties, damages, settlement payments, judgments and awards), of whatever kind or nature, known or unknown, contingent or otherwise, arising out of, or in any way relating to, any actual or alleged violation of, noncompliance with or liability under any Environmental Laws. Environmental Costs include any and all of the foregoing, without regard to whether they arise out of or are related to any past, pending or threatened proceeding of any kind.
Environmental Costs means costs incurred in connection with acquiring and maintaining all environmental permits and licenses for the Product, and the Product’s and Project’s compliance with all applicable environmental Laws, rules and regulations, including capital costs for pollution mitigation or installation of emissions control equipment required to permit or license the Product or Project, all operating and maintenance costs for operation of pollution mitigation or control equipment, costs of permit maintenance fees and emission fees as applicable, and the costs of all Emission Reduction Credits, Marketable Emission Trading Credits, and any costs related to greenhouse gas emissions, required by any applicable environmental Laws, rules, regulations, and permits to operate, and costs associated with the disposal and clean-up of hazardous substances introduced to a Site or the Project, and the decontamination or remediation, on or off a Site or the Project, necessitated by the introduction of such hazardous substances on a Site or the Project.
Environmental Costs means all costs and expenses of any kind (including capitalized and non-capitalized costs, legal fees and expenses, and fines, penalties, and interest) incurred in connection with (a) the application for, or acquisition, maintenance, or modification of, the environmental Governmental Approvals for the Facility or (b) compliance or non-compliance with all applicable past, present, or future environmental Governmental Approvals or Laws arising out of or relating to the Facility.

  • Seller shall be solely responsible for all Environmental Costs with respect to the Project other than those encompassed in Section 13.4 which are the responsibility of Buyer.

  • In the event Licensee fails to perform any of its obligations under this section or any Environmental Laws, the County shall have the right, upon giving Licensee ten (10) business days written notice, except no prior notice shall be required in the event of an emergency, to perform such obligations and charge Licensee all resulting Environmental Costs.

Environmental Costs means any and all costs and expenditures, including any fees and expenses of attorneys and of environmental consultants or engineers incurred in connection with investigating, defending, remediating or otherwise responding to any Release of Hazardous Materials, any violation or alleged violation of Environmental Law, any fees, fines, penalties or charges associated with any Governmental Authorization, or any actions necessary to comply with any Environmental Law.
Environmental Costs means the costs and expenses of implementing Environmental Actions and the costs of payment of certain oversight costs of any Beneficiary with respect to the Cimarron Site.
