Excluded Defect means a defect in the Communications Services or Licensed Technology caused by any of the following:

Examples of Excluded Defect in a sentence

  • In connection with any determination as to whether an Excluded Defect exists, an admission of liability concerning a settlement of a lawsuit will not in and of itself constitute an admission of the existence of facts that would constitute an Excluded Defect.

  • Storman has no obligation to maintain or support any problems, issues, defects or non- compliances in the Service or Add-Ons, to the extent caused or contributed to by the access to, or use of, the Service or Add-Ons in breach of the Documentation or other provisions of this Agreement or other misuse or arising from the acts or omissions of a third party (other than Storman Personnel) ( Excluded Defect).

  • An Excluded Defect Notice shall include all known grounds on which Xxxxxx Xxx determined that a loan has an Excluded Defect.

Related to Excluded Defect

  • Excluded Day shall have the meaning set forth in Section 2.3.1(b).

  • Excluded Amount For any Payment Date on or after the occurrence of an Amortization Event, the portion of the balance with respect to each HELOC attributable to all Draws not transferred to the Trust, and the portion of the Principal Collections (other than Net Liquidation Proceeds to the extent that the Excluded Amount of Liquidation Proceeds is not included in Net Liquidation Proceeds) and Interest Collections thereon for each Collection Period allocated to such Excluded Amount based on a pro rata allocation between the related Excluded Amount and the Loan Balance in proportion to the respective amounts outstanding as of the end of the calendar month preceding such Collection Period.

  • Specified Materials means the basic materials required on the Site for the execution and completion of Works, which shall include fuel and lubricants; cement; aggregates; steel reinforcement; timber and gravel.

  • Latent Defects means such defects caused by faulty designs, material or work-man- ship which cannot be detected during inspection, testing etc, based on the technology available for carrying out such tests.

  • Excluded Items means any items which the Committee determines shall be excluded in fixing Performance Goals, including, without limitation, any gains or losses from discontinued operations, any extraordinary gains or losses and the effects of accounting changes.
