Exempted Project definition

Exempted Project shall have the meaning set forth in Section 3.3(b).
Exempted Project is a collective reference to each of the Brazos Valley Project, Meriden Project, Nelson Project (including the turbines associated therewith) axx Xxxe Project (including the turbines associated therewith). NRG Energy may designate as an Exempted Project one or more additional projects that, in its reasonable judgment, do not warrant continued funding upon (a) the delivery of the Business Plan so long as the addition thereof as Exempted Projects is consistent with the treatment thereof in the Business Plan or (b) upon prior written notice with respect to such additional project being given to the Agents.

Examples of Exempted Project in a sentence

  • Exempted Project Description (EPD): A legally binding description of the project, including all the project components and activities and their locations with any required constraints.

  • NRG Energy shall take all steps and actions and otherwise cooperate with each Agent party to an Exempted Project Debt Instrument as such Agent may reasonably request in connection with the preservation of the value of each Exempted Project and appropriate safeguarding and remediation efforts with respect thereto to the extent such request entails no material expenditure or disadvantage to NRG Energy that may materially and adversely affect creditors of NRG Energy.

  • Projects whose total combined disturbed areas and construction support activities (i.e. staging areas, soil stockpile areas, etc.) are one (1) acre or more do not qualify as an Exempted Project.

  • Additionally, projects that are part of a larger common plan of development that will ultimately disturb one acre or more of total land area also do not qualify as an Exempted Project.

Related to Exempted Project

  • Development Property means a Property currently under development for use as an office or industrial building that has not become a Stabilized Property, or on which the improvements (other than tenant improvements on unoccupied space) related to the development have not been completed, provided that such a Development Property on which all improvements (other than tenant improvements on unoccupied space) related to the development of such Property have been completed for at least twelve (12) months shall cease to constitute a Development Property notwithstanding the fact that such Property has not become a Stabilized Property.

  • Redevelopment Property means a property owned by the Company or a Consolidated Subsidiary (a) where the commenced leased square footage is less than 60% of the sum of net rentable square feet and redevelopment space, with reasonable adjustments to leased square footage determined in good faith by the Company, including adjustments for available power, required support space and common area and (b) that the Company reasonably characterizes as held in whole or in part for redevelopment.

  • Excepted Property has the meaning specified in the Granting Clauses of this Indenture.

  • Capital Improvement Project means the acquisition, construction, reconstruction, improvement, planning and equipping of roads and bridges, appurtenances to roads and bridges to enhance the safety of animal-drawn vehicles, pedestrians, and bicycles, wastewater treatment facilities, water supply systems, solid waste disposal facilities, and storm water and sanitary collection, storage and treatment facilities including real property, interests in real property, facilities, and equipment related or incidental to those facilities.

  • Developed Property means all Assessor’s Parcels of Taxable Property for which Building Permits were issued on or before May 1 of the prior Fiscal Year, provided that such Assessor's Parcels were created on or before January 1 of the prior Fiscal Year and that each such Assessor's Parcel is associated with a Lot, as determined reasonably by the Board.

  • Redevelopment project means any work or undertaking

  • Qualified project means the construction or expansion of any capital project of the Borrower or any of its Restricted Subsidiaries, the aggregate actual or budgeted capital cost of which (in each case, including capital costs expended by the Borrower or any such Restricted Subsidiaries prior to the construction or expansion of such project) exceeds $50,000,000.

  • Economic development project means land and existing or planned improvements suitable for use by an industrial or commercial enterprise, or housing development, or the protection of the environment, including, but not limited to, groundwater or surface water. Economic development project includes necessary buildings, improvements, or structures suitable for and intended for or incidental to use as an industrial or commercial enterprise or housing development; and includes industrial park or industrial site improvements and port improvements or housing development incidental to an industrial or commercial enterprise; and includes the machinery, furnishings, and equipment necessary, suitable, intended for, or incidental to a commercial, industrial, or residential use in connection with the buildings or structures.

  • Undeveloped Property means all Assessor’s Parcels of Taxable Property which are not Developed Property.

  • Approved Project means the Scheme application of the Applicant approved by the CIC.

  • Qualifying project means (i) any education facility, including, but not limited to a school building, any functionally related and subordinate facility and land of a school building (including any stadium or other facility primarily used for school events), and any depreciable property provided for use in a school facility that is operated as part of the public school system or as an institution of higher education; (ii) any building or facility that meets a public purpose and is developed or operated by or for any public entity; (iii) any improvements, together with equipment, necessary to enhance public safety and security of buildings to be principally used by a public entity; (iv) utility and telecommunications and other communications infrastructure; (v) a recreational facility; (vi) technology infrastructure and services, including, but not limited to, telecommunications, automated data processing, word processing and management information systems, and related information, equipment, goods and services; (vii) any technology, equipment, or infrastructure designed to deploy wireless broadband services to schools, businesses, or residential areas; or (viii) any improvements necessary or desirable to any unimproved locally- or state-owned real estate.

  • Partnership Property means any property, real, personal or mixed, or any interest therein or appurtenant thereto which may be owned or acquired by the Partnership.

  • Operating Property means any property owned, leased, or operated by the Party in question or by any of its Subsidiaries or in which such Party or Subsidiary holds a security interest or other interest (including an interest in a fiduciary capacity), and, where required by the context, includes the owner or operator of such property, but only with respect to such property.

  • Qualified Project Costs shall have the meaning given to it in the Regulatory Agreement.
