No later than ninety (90) days following the Commercial Operation Date, Seller must provide Utility the As-Built Supplement which will be incorporated into Exhibits B and C of this Agreement and if applicable, an updated statement of Expected Net Output that will be incorporated in Exhibit A of this Agreement.
During the term of this Agreement, Seller may not (i) increase the Nameplate Capacity Rating of the Facility; or (ii) except to the extent Seller complies with the requirements of Section 6.7.3, increase the Expected Net Output of the Facility, as that term is defined as of the Effective Date, by more than ten percent (10%); in either case, through any means, including replacement or modification of Facility equipment or related infrastructure.
