In such case, the Contractor shall cease performance of the Project or the applicable portion thereof to the extent specified in the notice, and MTD shall pay the Contractor allowable costs and applicable profit thereon incurred to the specified date of termination. If it is later determined by MTD that the Contractor did not breach the Agreement and had an excusable reason for not performing, MTD may at it’s sole discretion set up a revised delivery or performance schedule for the Agreement or applicable
